    The FEDERAL road to SMP and WATER HELL was PAVED with good intentions?

    AND HOW MUCH FEDERAL MONEY?

    When the Federal Coastal Zone Management Act came along, it said, if a state wants to do a program, here’s some MONEY to do it; then, once it’s done, here’s some MORE MONEY to manage it.

    There’s a definite tie. The Federal Coastal Zone Management Act came about in ’72 at virtually the same time our Shoreline Management Act was finally approved.

    We were watching it very closely, because the federal law provides SUBSTANTIAL FUNDING to states that develop management programs. Here, we had the Shoreline Management Act.

    SHORELINE MANAGEMENT BY APPOINTED FEDERAL AGENCIES.

    Shoreline Act 40, 263 From 1971-2005

    1971 The ENVIRONMENTALISTS proposed the state’s jurisdiction would include 500 feet back from the water’s edge, providing for a strip of land, 500 feet wide, that would be the jurisdiction of their bill.

    1971 They, the ENVIRONMENTALISTS also placed primary, almost exclusive, planning and REGULATORY AUTHORITY WITH THE DEPARTMENT OF ECOLOGY, instead of LOCAL GOVERNMENT
    Resulting in a very STRONG ROLE by the STATE and a much lesser role by LOCAL GOVERNMENT.

    That initiative got enough signatures to go on to the ballot at the next general election. Seeing that, THE LEGISLATURE THEN DECIDED, as is allowed and provided for under the state’s constitution, to enact their version to put on the ballot, which was the 1972 SHORELINE MANAGEMENT ACT, which ultimately passed. The basic difference between the initiative and the act was that the act named a strip 200 feet from the water’s edge as the area of jurisdiction, and then set up the joint state/local approach.

    From an environmental standpoint, given the two versions of the shorelines legislation, the environmentalist version talked about a jurisdictional area. In other words, what areas, what pieces of geography, the act applied to.

    Our Shoreline Management Act was probably, with maybe the exception of California, the strongest law of its kind in the country at the time. This was right at the beginning of the ENVIRONMENTAL MOVEMENT, and what we were doing was groundbreaking. It wasn’t a case where we could pick up the phone and call some other state and say, hey, what did you guys
    do in dealing with this? Other states were calling us.

    The WA State DOE, state policy people asked Steve Gray Deputy Director Clallam County
    Department of Community Development for my contact information, by name as an individual, Pearl Rains Hewett.

    Regional Director Paula Ehlers called me at home and requested a private meeting with me.

    We had the meeting on June 6, 2012. (4) DOE employees, Gordon White (The WA State Manager of Shoreline Programs) Paula Ehlers (Regional Director ) Peter Skowland and Clallam County DOE rep. Jeffree Steward drove up from Olympia for our private meeting.

    Paula Ehlers told me I was allowed to invite 2-3 people. I invited (7).

    Steve Gray, Deputy Director/Planning Manager
    Dr.Robert Crittenden, biologist, expert witness and paid consultant.
    Dick Piling, Realtor, Republican Chairman of Clallam County
    Harry Bell, Business men’s assoc. He is Green Crow, the company owns a lot of WA State forestland, he is well know at state level SMP Advisory Committee
    Connie Beauvais, Manager of Crescent Water District, informed, active Member of the Appointed Planning Dept.
    MD retired, Karl Spees, SMP Advisory Committee, CAPR 13, very active private property owner
    Attorney Mary Pfaff, Member of the SMP Advisory Committee, had a Dr. appointment and did not attend.

    The WA State DOE Team, was a lot more interested in my guests, than they were in me.
    None of the invited (6) that attended were asked to leave.
    Interesting to note, we had the meeting at the courthouse (Steve Gray reserved the room) On the way into the DOE meeting, we ran into several interesting? interested? people. Sheila Rourke Miller, Jim McEntire and Mike Chapman.

    WHAT WAS THE MEETING AGENDA? Intel?
    DOE? I have no idea?
    I asked all of my invited guests to independently, based on their area of expertise and concerns, to prepare (5) questions for the DOE meeting.

    I personally, showed them the map, graphically demonstrating the SMP TAKING affected of the 175′, 150 plus 10′ setback on Burt Reid’s 7 acre priority feeder bluff private property. I spoke of the other property owners, all 474 of them, up to 88% would become totally non-conforming.

    I asked them, as I pointed to the map, as the US Supreme Court Justices asked an EPA witness in the 9 to zero ruling against the EPA, on the Sackett Case, “If this was your investment property? How happy would you be? What would you do? Just plant a few bushes and walk away?

    I did not take notes, I did listened and made an occasional indignant comment.
    By definition, “indignant” Angry at unfairness angry or annoyed at the apparent unfairness or unreasonableness of something.

    We did agreed that we were all American’s first and we do recognize private property rights.
    WHAT DID WE ACCOMPLISH – LEARN?

    Gordon White told us that, the appointed WA State Ecology Director Ted Sturdevant, (ANOTHER BUREAUCRAT)  is aware of the concerns of the Clallam County private property owners (all 3300 of us)

    WA State DOE is not required to provide an economic impact statement for Clallam County.

    My personal conclusion,
    The DOE is aware of the SMP economic impact on Clallam County government.
    The DOE is aware that they are TAKING private property value without compensation.
    The DOE is aware, that If private property owners keep fighting, we can reduce the setbacks, through our local government.

    My conclusions are based on the following
    18 months of research on line,
    WA State Law, protection of private property
    WAC’S, DOE proposed budget 2010-2013
    WA State Public Trust Doctrine
    Lawsuits, WA State Supreme Court Rulings
    United States Supreme Court Rulings
    Pacific Legal Foundation battles and BIG WINS
    documented information on many other WA State SMP’S,
    “Conspiracy Exposed” George C. Rains Sr.
    “Access Denied to inholder property”,
    Attending county meetings, public forums,
    Reading every word of the Clallam County DOE SMP Update and every SMP Public Comment,
    Clallam County Chapter 35,
    Water rights, reserved water rights,
    60 years of recorded history from George C. Rains Sr.
    To name just a FEW areas I have researched, questioning, challenging, communicating and disseminating all of it. (can what I know hurt them?)

    I have great things going for me.
    I AM AN AMERICAN
    I AM NOT AFRAID OF WHAT THE GOVERNMENT IS GOING TO DO TO ME.

    Confederate Memorial

    By the end of 1901 all the Confederate soldiers buried in the national cemeteries at Alexandria, Virginia, and at the Soldiers’ Home in Washington were brought together with the soldiers buried at Arlington and reinterred in the Confederate section.

    The history of Arlington National Cemetery is steeped in the Civil War, for it was this great national struggle that necessitated the establishment of this cemetery to bury its many dead. For many years following the war, the bitter feelings between North and South remained, and although hundreds of Confederate soldiers were buried at Arlington, it was considered a Union cemetery. Family members of Confederate soldiers were denied permission to decorate their loved ones’ graves and in extreme cases were even denied entrance to the cemetery.

    These ill feelings were slow to die but over time they did begin to fade. Many historians believe it was the national call to arms during the Spanish-American War that brought northerners and southerners together at last. In that war numerous Confederate veterans volunteered their services and joined their Northern brothers on the battlefield in the common defense of our nation. In June 1900, in this spirit of national reconciliation, the U.S. Congress authorized that a section of Arlington National Cemetery be set aside for the burial of Confederate dead.

    By the end of 1901 all the Confederate soldiers buried in the national cemeteries at Alexandria, Virginia, and at the Soldiers’ Home in Washington were brought together with the soldiers buried at Arlington and reinterred in the Confederate section. Among the 482 persons buried there are 46 officers, 351 enlisted men, 58 wives, 15 southern civilians, and 12 unknowns. They are buried in concentric circles around the Confederate Monument, and their graves are marked with headstones that are distinct for their pointed tops. Legend attributes these pointed-top tombstones to a Confederate belief that the points would “keep Yankees from sitting on them.”

    To further honor these citizens of the South, the United Daughters of the Confederacy petitioned to erect a major monument to the Confederate dead. On March 4, 1906 Secretary of War William Howard Taft granted their request. The cornerstone was laid on Nov. 12, 1912 at a ceremony featuring speakers William Jennings Bryan and James A. Tanner, a former Union corporal who lost both legs at the second Battle of Bull Run. He was commander in chief of the Union veterans group, The Grand Army of the Republic. That same evening, President William Howard Taft addressed the United Daughters of the Confederacy at a reception in the Daughters of the American Revolution’s Centennial Hall.

    Chosen to design the memorial was the world-renowned sculptor, Moses Ezekiel. Ezekiel brought more than just his artistic talents to this project for he was also a Confederate veteran who knew firsthand the horrors of the Civil War. He is now buried at the base of the famous monument which he created.

    The Confederate Monument was unveiled before a large crowd of northerners and southerners on June 4, 1914, the 106th anniversary of the birthday of the president of the Confederacy, Jefferson Davis. President Woodrow Wilson delivered an address and veterans of both the Union and Confederacy placed wreaths on the graves of their former foes, symbolizing the reconciliation between the North and South, the memorial’s central theme.

    Ezekiel created a monument rich in symbols. Standing atop the 32-foot monument is a larger-than-life figure of a woman representing the South. Her head is crowned with olive leaves, her left hand extends a laurel wreath toward the South, acknowledging the sacrifice of her fallen sons. Her right hand holds a pruning hook resting on a plow stock. These symbols bring to life the biblical passage inscribed at her feet: “And they shall beat their swords into plow shares and their spears into pruning hooks.”

    The plinth on which she stands is embossed with four cinerary urns symbolizing the four years of the Civil War. Supporting the plinth is a frieze of 14 inclined shields, each depicts the coat of arms of one of the 13 Confederate states and Maryland, which did not join the Confederacy but supported the South in the war.

    Below the plinth is another frieze of life-sized figures depicting mythical gods and Southern soldiers. At the front of the monument, the panoplied figure of Minerva, Goddess of War and Wisdom, attempts to hold up the figure of a fallen woman (“The South”) who is resting upon her shield, “The Constitution.” Behind “The South,” the Spirits of War are trumpeting in every direction calling the sons and daughters of the South to aid their falling mother. On either side of the fallen woman are figures depicting those sons and daughters who came to her aid and who represent each branch of the Confederate service: Soldiers, Sailor, Sapper and Miner.

    Completing the frieze are six vignettes illustrating the effect of the war on Southerners of all races. The vignettes include a black slave following his young master; an officer kissing his infant child in the arms of her mammy; a blacksmith leaving his bellows and workshop as his sorrowful wife looks on; a young lady binding the sword and sash on her beau; and a young officer standing alone.

    The base of the memorial features several inscriptions. On its front face are the seal of the Confederacy and a tribute by the United Daughters of the Confederacy, followed by the Latin phrase: “Victrix Causa Diis Placuit Sed Victa Caton.” This phrase means: “The Victorious Cause was Pleasing to the Gods, But the Lost Cause to Cato.” On the rear of the monument is an inscription attributed to the Reverend Randolph Harrison McKim, who was a Confederate chaplain and who served as pastor of the Epiphany Church in Washington for 32 years. It reads:

    In addition to Moses Ezekiel, three other Confederate soldiers are buried at the base of the monument. They are Lt. Harry C. Marmaduke who served in the Confederate Navy, Capt. John M. Hickey of the Second Missouri Infantry and Brig. Gen. Marcus J. Wright who commanded brigades at Shiloh and Chickamauga.

    National and global events all happened some­where, and historical markers mark the place where many occurred. But the richness of history is in its local details, details that can be insignificant on the global stage: the home of an in­di­vi­dual who made a dif­fe­rence; a natural feature, building, byway; or just some­thing in­te­res­ting that happened nearby. History is not just about the high and mighty.

    Markers tell stories and point out facts. There is one at the site the northernmost battle of the U.S. Civil War and another at the southernmost point in the United States (can you guess where?). There is one next to a 17th century Japanese stone lantern symbolizing 20th century peace, and another one less than 20 miles away reminding us of the Nike missile sites that were built the same year the lantern was dedicated. They tell of battles,  massacres and hangings; of hu­ma­ni­ta­rians, educators, and a beloved stagecoach horse; of mountains, lakes, rivers, bridges, roads, and other natural and man-made wonders.

    There are countless thousands of great stories marked by markers—and some boring ones too. Some markers simply recite facts while others are insightful, obscure, cryptic, patriotic, fas­ci­na­ting, sad, funny, or just downright bizarre. Many of those markers are on these pages, others are waiting for you to discover and add them to this database.

    AKRON, OhioDRUG OVERDOSE DEATHS IN 2016 MOST LIKELY EXCEEDED 59,000, the largest annual jump ever recorded in the United States, according to preliminary data compiled by The New York Times.

    The death count is the latest consequence of an escalating public health crisis: opioid addiction, now made more deadly by an influx of illicitly manufactured fentanyl and similar drugs.

    In 2016, Summit County, Ohio had 312 drug deaths, according to Gary Guenther, the county medical examiner’s chief investigator —

     A 46 PERCENT INCREASE FROM 2015 AND MORE THAN TRIPLE THE 99 CASES THAT WENT THROUGH THE MEDICAL EXAMINER’S OFFICE JUST TWO YEARS BEFORE.

Only crime lab submissions from an agency clearly operating within a single county were associated with a county. Those originating from multi-county agencies, such as cross-jurisdiction drug task forces, some Washington State Patrol detachments, or federal law enforcement, are included in the state-wide rate.

    OPIOID USE, MORBIDITY, AND MORTALITY HAVE INCREASED NATIONALLY AND ACROSS WASHINGTON STATE. To provide insights into how and where changes are occurring, several data sources are mapped. Crime lab, treatment, and mortality data are presented for 2002–2004 and 2011–2013, to show patterns over time. These maps combine heroin and prescription-type opioids as those abusing these drugs often use them interchangeably, and interventions, treatment and the opioid overdose antidote naloxone, work equally well for both types of opioids.

    Crime lab data for police evidence testing indicate an 85% increase statewide, with increases in most counties. Publicly funded drug treatment admissions for opioids as the primary drug increased 197% statewide, with increases in 38 of 39 counties. Drug caused deaths involving opioids increased 31% statewide, with increases in most counties.

    The total number of drug caused deaths involving opioids in 2013 was 608, with 6,668 deaths total from 2002–2013. The annual rate of opioid deaths has not changed from 2008 to 2013.

    Fresh off its efforts to end the scourge of left-lane slowpokes, Washington State is preparing to enact one of the nation’s toughest distracted driving laws after legislators passed a bill outlawing nearly every conceivable form of attention-diverting behavior behind the wheel.

    Starting Sunday, drivers will no longer be allowed to use handheld devices at all, even while stopped in traffic or doing something as simple as scrolling through a playlist. Say goodbye to your red light selfies and social media spot-checks; officers who spot a driver with a phone in hand at any time for any reason can issue a ticket starting at $136, and repeat offenders will see that fine rise to $234 per violation.

    Additionally, a whole slew of other common sights—smoking, eating, drinking, reading, and “grooming”—are now secondary offenses, meaning drivers can be handed a $99 ticket for any of these actions if they’re pulled over for something else. So that guy you see on your morning commute making the illegal merge while shaving and eating his McMuffin is in for a rude awakening.

    Washington’s new E-DUI law will undoubtedly be a sticking point for some people. We can all agree that texting (and reading, and grooming, and sometimes eating) is indeed distracting when controlling a multi-ton vehicle, and therefore probably shouldn’t be allowed. But can the same be said for drinking a bottle of water? Or smoking a cigarette? It can be argued that anything other driving is a distraction behind the wheel, but it doesn’t take too much effort to imagine a driver suing the state over a disputed ticket and the law’s true intent.

    I received the call on my time,  12:50 PM West Coast time.

    We had about a 20 minute conversation.

    I have been emailing  a bunch of the postings on this website to Rep Kilmer on his “contact me”.  Checking the box I want a response.

    It took some goading, doing something continuously, provoking and  annoying, to stimulate action, reaction but I finally got  a  response from Kilmer’s office in WA DC.

    What  I want from WA STATE Representative Derek Kilmer?

    Really? What do I want? This is my 920th posting on behindmyback.org. established  Jan 29, 2013

    Simply put, I want what Abraham Lincoln   wanted on Nov 19, 1863 “Gettysburg Address” that we here highly resolve that these dead shall not have died in vain-that this nation, under God, shall have a new birth of freedom-and that government of the people, by the people, for the people shall not perish from the earth.

    As a concerned American Grandmother, with three children, (10) grandchildren and (9) great grand children…

    I want exactly the same as We the hard working  American citizens want, the WA DC. establishment  of elected Representatives, both Republican’s  and Democrat’s to work for the American people not the party.

    What “we the American people want” is for all elected MEMBERS OF CONGRESS et al, like resistance, bad mouthing, obstructing, Schumer, Maxine Waters, Cummins, Pelosi, Feinstein, Pocahontas, Cantwell, Murray, and Kilmer to follow the lead of President Trump and put America and the American people first.

    Kilmer’s Martha and I talked for about 20 minutes, partly about lies and atrocities committed in America.

    The Benghazi lies, that I knew about two weeks after it happened and told Kilmer about in 2012.  The media cover up of the rape of a five year old developmentally disabled girl in Twin Falls Idaho, (got no response from Kilmer, Cantwell or Murray)  Female genital mutilation,  by a doctor Detroit U.S.A.  practicing medicine in Henry Ford Hospital.

    Martha said she would check out my website.

    And,  when Martha asked me What I wanted  Rep Kilmer to do about Obamacare, I said, I want Rep Kilmer to stand up in the U.S. House of Representative, cross the isle, and support a bipartisan fix in the best interest of the American people..

    I asked Martha to let me know when Rep Kilmer will be on C-SPAN doing it.

    When I think about the next four years, I think about the future I want for my two little girls. I want my daughters – and all kids – to be able to get a top-notch education where their class sizes are small and their teachers are treated like professionals. As they grow older, I want my kids to be able to go to college without taking on mounds of debt. When they’re old enough, I want each of them to be able to get a good job that pays a good wage and has decent benefits – where they’re respected as working people. I want that for all Americans. I want my daughters to grow up in a world where discrimination is a thing of the past – where regardless of your race, religion, gender, orientation, ethnicity, ability or disability, you are a valued member of our community and our country. I want that future for them.     I will also do all I can to ensure that Congress exercises its oversight authority and advocates for the rule of law. The Constitution calls for protection of civil rights and civil liberties. It calls for the protection of free speech, freedom of religion, and a free press. It created an independent judiciary, empowered to review the actions of the executive branch to ensure they are legal and Constitutional. I respect that, and I’ll do everything in my power to make sure that our president respects those principles as well.

    Abraham Lincoln once said, “Public sentiment is everything.” If we are going to advance thoughtful, positive policies and if we are going to stop wrong-headed, divisive ones, we need citizens like you to be engaged. Thank you for that.
