    ECOLOGY’S Introduction

    Under Chapter 70.105D RCW, Ecology administers a program for GRANTS TO

     “PERSONS WHO MAY BE ADVERSELY AFFECTED BY A RELEASE OR THREATENED RELEASE OF A HAZARDOUS SUBSTANCE AND NOT-FOR-PROFIT PUBLIC INTEREST GROUPS”.

    Grants are used to “facilitate public participation in the investigation and remediation of a release OR THREATENED RELEASE OF A HAZARDOUS SUBSTANCE and to implement the state’s solid and hazardous waste management priorities.”

    (1) ELIGIBLE PROJECT COSTS FOR SUBSTANCE RELEASE GRANTS SHALL INCLUDE BUT NOT BE LIMITED TO:

    (A) HIRING TECHNICAL ASSISTANTS TO REVIEW AND INTERPRET DOCUMENTS;

    (b) PUBLIC INVOLVEMENT and public education activities;

    (C) REVIEWING SPECIFIC PLANS FOR ENVIRONMENTAL TESTING AND ANALYSIS, REVIEWING REPORTS SUMMARIZING THE RESULTS OF SUCH PLANS AND MAKING RECOMMENDATIONS FOR MODIFICATIONS TO SUCH PLANS.

    (D) EXPENDABLE PERSONAL PROPERTY;

    (E) OTHER PUBLIC PARTICIPATION ACTIVITIES AS DETERMINED BY THE DEPARTMENT ON A CASE-BY-CASE BASIS.

    (2) ELIGIBLE PROJECT COSTS FOR WASTE MANAGEMENT

     PRIORITY GRANTS SHALL INCLUDE BUT NOT BE LIMITED TO:

    (a) Assisting in DEVELOPING AND IMPLEMENTING PROGRAMS that promote or improve state or local solid or hazardous waste management plans;

    (b) Assisting in developing programs or activities that promote and are consistent with the state solid or hazardous waste management priorities;

    (C) EXPENDABLE PERSONAL PROPERTY;

    (D) OTHER PUBLIC PARTICIPATION ACTIVITIES AS DETERMINED BY THE DEPARTMENT ON A CASE-BY-CASE BASIS.

    (3) Ineligible projects and grant costs shall include but not be limited to:

    (a) Independently collecting or analyzing samples at facility sites;

    (B) HIRING ATTORNEYS FOR LEGAL ACTIONS AGAINST POTENTIALLY LIABLE PERSONS, FACILITY OWNERS, OR THE DEPARTMENT. APPLICANTS WHO RECEIVE A GRANT AWARD SHALL NOTIFY THE DEPARTMENT IF LEGAL ACTION IS INTENDED OR TAKEN ON THE SUBJECT OF THE GRANT PROJECT OR APPLICATION;

    (C) LEGISLATIVE LOBBYING ACTIVITIES;

    (d) Real property;

    (e) Nonexpendable personal property.

    Public Participation Grants

    Overview

    Introduction

    Under Chapter 70.105D RCW, Ecology administers a program for grants to “persons who may be adversely affected by a release or threatened release of a hazardous substance and not-for-profit public interest groups”. Grants are used to “facilitate public participation in the investigation and remediation of a release or threatened release of a hazardous substance and to implement the state’s solid and hazardous waste management priorities.”

    Why are we doing this rulemaking?
    In 2016, Ecology obtained an independent audit of our Public Participation Grants program. The current application process for the grants requires a significant amount of time and agency resources to establish applicant eligibility and award the grants. Changes Ecology is proposing are either specific audit recommendations or based on the agency’s experiences implementing the program.

    Input from past grant recipients and other stakeholders also indicated a need to increase the emphasis the PPG program places in reaching disadvantaged communities adversely affected by toxic contamination and cleanup work. Updating the rule now will allow us to apply these changes to grants awarded in the 2017-19 biennium.

    Scope of rulemaking
    Ecology proposes to:

    • Revise program priorities to include environmental justice
    • Revise eligibility requirements
    • Clarify the criteria used to evaluate applications
    • Revise eligible costs
    • Develop a method for renewing grants annually per Chapter 70.105D RCW
    • Streamline the grant application and evaluation process to increase consistency, transparency, objectivity, and efficiency
    • Revise the grant application process to authorize electronic submittals
    • Update grant administration requirements
    • Align Chapter 173-321 WAC to current program needs.

    Ecology will periodically update these web pages to provide up-to-date information about this rulemaking. We will notify interested parties through the agency email listserv (WAC Track), a Waste 2 Resources ListServ specifically established for the Public Participation Grants program. We will e-mail contacts identified in our grants-related database and those identified by grants staff. We will publish notice in the Washington State Register as we move through the process.     “A Disaster of the First Magnitude”

    THESIS:   Churchill attacks the Munich agreement as a failure of the Western powers to prevent the Nazi power from gaining momentum when it had the chance and has therefore jeopardized the peace they were trying to maintain.

    • Winston Churchill (1874-1965) delivers a speech on October 5, 1938 in the House of Commons attacking the Munich agreement and British policy toward Nazi Germany
    • Churchill begins by stating they have faced defeat in the Munich agreement and the Czechs would of even been better off with the Western powers that deserted them.
    • He continues that if a better relationship with Russia had been pursued and early action had been taken then the disastrous state at hand would not have happen.
    • Also the peace efforts and forces against Hitler in Germany would have been able to gain strength if early action had been taken.
    • Church now describes the politically humiliated and economically mutilated Czechoslovakia, whose banks, railway agreements, and industries are all disrupted.
    • Churchill seals the fate of Czechoslovakia by predicting it will be absorbed by the Nazis in despair or revenge
    • He now addresses Britain’s previous position of power when they had the ability to stop Germany from rearming and gaining momentum but they are now faced with what they could have prevented.
    • Churchill finishes by explaining the danger that Britain and France now face against the Nazi power with France’s allies lost and both countries waiting too long to rearm or take action.
    • Churchill states that the British people must know the deficiency of and neglect of the government and the consequences they will now face.

    The sanctuary jurisdictions are listed below. These cities, counties, and states have laws, ordinances, regulations, resolutions, policies, or other practices that obstruct immigration enforcement and shield criminals from ICE — either by refusing to or prohibiting agencies from complying with ICE detainers, imposing unreasonable conditions on detainer acceptance, denying ICE access to interview incarcerated aliens, or otherwise impeding communication or information exchanges between their personnel and federal immigration officers.

    A detainer is the primary tool used by ICE to gain custody of criminal aliens for deportation. It is a notice to another law enforcement agency that ICE intends to assume custody of an alien and includes information on the alien’s previous criminal history, immigration violations, and potential threat to public safety or security.

    The Center’s last map update reflected listings in an ICE report published on March 20, 2017.

    Summary

    Pursuant to section 9(b) of Executive Order 13768, Enhancing Public Safety in the Interior of the United States, and section H of the Secretary of Homeland Security’s subsequent implementation memo,

    Enforcement of the Immigration Laws to Serve the National Interest, U.S. Immigration and Customs Enforcement (ICE) is making available for public release the non-Federal jurisdictions that release aliens from their custody, notwithstanding that such aliens are subject to a detainer or similar request for

    custody issued by ICE to that jurisdiction.

    For instances of such release, the report also includes the associated individual’s citizenship, detainer issued and declined dates, and notable criminal activity.

    ICE compiled this report based on jurisdictions with detainers that were recorded as declined

    between January 28, 2017, and February 3, 2017, regardless of detainer issuance date

    It should be noted that law enforcement agencies (LEA) do not generally advise ICE of when a detainer is not honored, and therefore this report represents declined detainers that ICE personnel have become aware of during their enforcement activities.

    This report is comprised of four sections:

    The US National Flood Insurance Program (NFIP) is an imperfect framework for reducing flood losses, but currently the best we’ve got

    NFIP IS SCHEDULED FOR CONGRESSIONAL REAUTHORIZATION IN 2017, and this debate promises to be lively. 

    The Natural Hazards Research and Mitigation Group at UC Davis has been analyzing NFIP DATABASES, EXAMINING PATTERNS OVER THE HISTORY OF THE PROGRAM AND FOCUSING ON FLOOD LOSSES AND FLOOD INSURANCE, PARTICULARLY IN CALIFORNIA.

    Over the history of NFIP, California is one of a few states that has – through dry years and wet – received only a small fraction of payments from NFIP compared to the premiums it has paid in.  Since 1994, NFIP damage payouts in California have totaled just 14% of premiums collected (compared to 560% for the biggest recipient state, Mississippi).  For California, this imbalance exceeds $3 billion (2015 dollars) over 21 years, funds that could have been invested in risk-reduction, floodplain management, and reduced premiums.

    California has unparalleled expertise and a culture of progressive solutions for managing its flood risk; the state also has unique needs and intense pressures looking forward.

    WITH THE US NFIP FACING AN UNCERTAIN FUTURE – >$20 BILLION IN DEBT,

    AND WITH A CHALLENGING CONGRESSIONAL REAUTHORIZATION DISCUSSION LOOMING IN 2017 –we recommend a careful look at California’s place in the NFIP.

    In particular, CALIFORNIA SHOULD NOW EXPLORE A STATE FLOOD INSURANCE PROGRAM, WITH SAVINGS INVESTED IN LONG-TERM RISK REDUCTION.  Properly implemented, a state-based insurance program and proactive flood mitigation strategies could synergistically benefit the environment, agriculture, recreation, and water resources.

    With one of the biggest storms in years set to hit Northern California this weekend, we headed to The Chronicle’s archive to find photos and stories from the infamous New Year’s storm of 1997 that walloped the region 20 years ago.

    The flooding’s toll came to eight dead, $1.8 billion in economic losses, 23,000 homes destroyed, and 2,000 businesses damaged or decimated. FORTY-EIGHT COUNTIES WERE DECLARED DISASTER AREAS, INCLUDING ALL 46 IN NORTHERN CALIFORNIA.

    • CALIFORNIA IS AT CATASTROPHIC RISK FOR DEVASTATING FLOODS.California’s diverse geography contributes to the state’s significant flood risk. In many regions, peak flows — the largest volume of water flowing per second through a water system — occur in a very short time frame, which spells disaster.
    • Flooding is a statewide problem. Every California county has experienced a federally declared flood disaster in the past 20 years. Counties with relatively low risk for a major flood event would be impacted by the results of a catastrophic flood elsewhere in the state, when employment centers, transportation facilities, utilities and the economy are affected.

    ACROSS THE US AND WORLDWIDE, FLOODING IS THE DEADLIEST AND MOST COSTLY NATURAL DISASTER.  The US National Flood Insurance Program (NFIP) is an imperfect framework for reducing flood losses, but currently the best we’ve got.  NFIP IS SCHEDULED FOR CONGRESSIONAL REAUTHORIZATION IN 2017, and this debate promises to be lively.  The Natural Hazards Research and Mitigation Group at UC Davis has been analyzing NFIP DATABASES, EXAMINING PATTERNS OVER THE HISTORY OF THE PROGRAM AND FOCUSING ON FLOOD LOSSES AND FLOOD INSURANCE, PARTICULARLY IN CALIFORNIA.

    Over the history of NFIP, California is one of a few states that has – through dry years and wet – received only a small fraction of payments from NFIP compared to the premiums it has paid in.  Since 1994, NFIP damage payouts in California have totaled just 14% of premiums collected (compared to 560% for the biggest recipient state, Mississippi).  For California, this imbalance exceeds $3 billion (2015 dollars) over 21 years, funds that could have been invested in risk-reduction, floodplain management, and reduced premiums.

    California has unparalleled expertise and a culture of progressive solutions for managing its flood risk; the state also has unique needs and intense pressures looking forward.  WITH THE US NFIP FACING AN UNCERTAIN FUTURE – >$20 BILLION IN DEBT, AND WITH A CHALLENGING CONGRESSIONAL REAUTHORIZATION DISCUSSION LOOMING IN 2017 – we recommend a careful look at California’s place in the NFIP.  In particular, CALIFORNIA SHOULD NOW EXPLORE A STATE FLOOD INSURANCE PROGRAM, WITH SAVINGS INVESTED IN LONG-TERM RISK REDUCTION.  Properly implemented, a state-based insurance program and proactive flood mitigation strategies could synergistically benefit the environment, agriculture, recreation, and water resources.  THIS APPROACH HAS MAJOR CHALLENGES, WITH IMPLICATIONS BOTH FOR CALIFORNIA AND NATIONWIDE THAT SHOULD BE EXPLORED.

    CHICAGO — Hundreds of people carried crosses Saturday for each person slain in Chicago this year during a quiet march along Michigan Avenue.

    The 3-foot-tall crosses were each engraved with the name of a homicide victim. The silence of the march was punctuated by demonstrators who spoke each name aloud. Authorities say more than 760 people were killed in Chicago in 2016. There were fewer than 500 homicides in the city last year.

    March organizer the Rev. Michael Pfleger said he hopes the visuals of the protest along Chicago’s premiere retail street will inspire people to take action to reduce violence in 2017.

    “This is a Chicago problem,” Pfleger said. “The reason we’re on Michigan Avenue is because this is a Chicago problem. And until everybody in Chicago decides it’s their problem we’re not going to end it.”

    Before the march Kelly Fitzgerald Clark found a cross with the name of her late husband. She cried as her son waded into a sea of crosses and retrieved it.

    “WE THOUGHT NOBODY CARED,” SHE SAID. “I LOST MY HUSBAND IN FEBRUARY. HOMICIDE. WE DIDN’T KNOW IT WAS GOING TO BE LIKE THIS.”

    THE CROSSES WERE MADE BY GREG ZANIS, OF AURORA.

    “I JUST WANT TO TELL EVERYBODY MY HEART’S BROKEN FOR YOU,” ZANIS SAID. “I DON’T KNOW WHAT ELSE TO DO BUT I DID A LITTLE BIT OF WORK FOR YOU GUYS.”

    After Saturday’s march, the crosses will be placed in a vacant lot on the city’s South Side.

    Dear President and Mrs. Obama,

    Now that lobbying for hosting the 2016 Olympic Games is behind us, a more urgent task is at hand. It is time for an Olympian effort to end the bloodshed plaguing the communities of Chicago.

    I implore you to make the elimination of violence in the windy city a top priority of your administration. If we agree that it would have been a worthwhile investment to prepare the city to host the 2016 Olympics, how much more is the value of human life? We must work to find a way to save lives, reduce hostility, and create a national model for the “audacity of hope” in all our urban areas suffering the scourge of senseless brutality.

    So I propose that the White House declare a Stop the Violence Olympics for Chicago. As immediately as is possible, an organizing effort should be made on the same scale as would have been necessary to prepare the city for the Olympics. Resources from throughout government, private industry, and the local community must be brought together in a collaborative effort that will serve notice that violence will no longer be tolerated.

    In addition, a torch should be lit in the city and remain burning as a reminder and symbol to all that we are serious about bringing change and hope to the affected Chicago communities.

    President and Mrs. Obama, with the eyes of the nation and the world upon the devastation in Chicago, the time has come to stand with courage and certainty to answer the question “Can they stop the violence on the streets of Chicago?”

    The only answer must be the same as the mantra of your Presidency—a resounding “YES WE CAN!”

    The number of murders in Chicago in 2016 was the highest in almost 20 years and more than Los Angeles and New York combined.

    The staggering numbers led a police spokesman to call it an “unacceptable rise in violence.”

    Altogether, 762 people were murdered in Chicago in 2016, police said. The numbers have prompted some to call Chicago “Chi-raq.”

    Police are blaming everything from lax gun laws to anger at police.

    The latter contention is controversial and is sometimes called the “Ferguson effect.” (Sorry Jessica, the link to shrinks Ferguson effect is not a fact)

    How big of a jump was it? In 2015, Chicago saw 480 murders. The 2016 murder numbers represent a 57 percent increase over the previous year, the biggest jump in 60 years.
