    AND HOW MUCH FEDERAL MONEY?

    When the Federal Coastal Zone Management Act came along, it said, if a state wants to do a program, here’s some MONEY to do it; then, once it’s done, here’s some MORE MONEY to manage it.

    There’s a definite tie. The Federal Coastal Zone Management Act came about in ’72 at virtually the same time our Shoreline Management Act was finally approved.

    We were watching it very closely, because the federal law provides SUBSTANTIAL FUNDING to states that develop management programs. Here, we had the Shoreline Management Act.

    SHORELINE MANAGEMENT BY APPOINTED FEDERAL AGENCIES.

    Shoreline Act 40, 263 From 1971-2005

    1971 The ENVIRONMENTALISTS proposed the state’s jurisdiction would include 500 feet back from the water’s edge, providing for a strip of land, 500 feet wide, that would be the jurisdiction of their bill.

    1971 They, the ENVIRONMENTALISTS also placed primary, almost exclusive, planning and REGULATORY AUTHORITY WITH THE DEPARTMENT OF ECOLOGY, instead of LOCAL GOVERNMENT
    Resulting in a very STRONG ROLE by the STATE and a much lesser role by LOCAL GOVERNMENT.

    That initiative got enough signatures to go on to the ballot at the next general election. Seeing that, THE LEGISLATURE THEN DECIDED, as is allowed and provided for under the state’s constitution, to enact their version to put on the ballot, which was the 1972 SHORELINE MANAGEMENT ACT, which ultimately passed. The basic difference between the initiative and the act was that the act named a strip 200 feet from the water’s edge as the area of jurisdiction, and then set up the joint state/local approach.

    From an environmental standpoint, given the two versions of the shorelines legislation, the environmentalist version talked about a jurisdictional area. In other words, what areas, what pieces of geography, the act applied to.

    Our Shoreline Management Act was probably, with maybe the exception of California, the strongest law of its kind in the country at the time. This was right at the beginning of the ENVIRONMENTAL MOVEMENT, and what we were doing was groundbreaking. It wasn’t a case where we could pick up the phone and call some other state and say, hey, what did you guys
    do in dealing with this? Other states were calling us.

    FEMA Emergency Funding was ending on Sept 30, 2017

    WASHINGTON (AP) — The House voted overwhelmingly on Friday to send a $15.3 billion disaster aid package to President Donald Trump, overcoming conservative objections to linking the emergency legislation to a temporary increase in America’s borrowing authority. The legislation also keeps the government funded into December 8, 2017.

    President Trump stepped across the aisle and  agreed to raise the debt limit and fund the federal government through December 8, 2017.

    All 90 “no” votes were cast by Republicans, following party lines, just like the Democrats on Obamacare.

    17 Republican senators were the only ones to vote against a measure to advance a bill that would provide emergency relief funding to the victims of Hurricane Harvey and temporarily raise the debt ceiling and fund the government through mid-December.

Bob Corker of Tennessee, Deb Fischer of Nebraska, Ron Johnson of Wisconsin, Jerry Moran of Kansas, Pat Toomey of Pennsylvania, Steve Daines of Montana, Jeff Flake of Arizona, JAMES LANKFORD of Oklahoma, RAND PAUL of Kentucky, Michael Enzi of Wyoming, LINDSAY GRAHAM of South Carolina, Mike Lee of Utah, James Risch of Idaho, Joni Ernst of Iowa, Chuck Grassley of Iowa, JOHN MCCAIN of Arizona and Ben Sasse of Nebraska.

    Lawmakers voted 80-17 in favor of sending the bill back to the House for renegotiations Thursday. The Senate’s vote comes off the heels of the measure passed in the House Wednesday, which allocated $7.85 billion for Hurricane Harvey relief funding with near-unanimous support.

    The large emergency funding package, linked to the debt ceiling and government spending, could be the result of a contentious deal struck in the Oval Office Wednesday afternoon. Instead of aligning with members of his own party and administration, Trump agreed to raise the debt limit and fund the federal government through mid-December, allowing members of Congress to deal with the federal budget in the coming months

    Officials in Houston are just beginning to grapple with the health and environmental risks that lurk in the waters dumped by Hurricane Harvey, a stew of toxic chemicals, sewage, debris and waste that still floods much of the city.

    Flooded sewers are stoking fears of cholera, typhoid and other infectious diseases. Runoff from the city’s sprawling petroleum and chemicals complex contains any number of hazardous compounds. Lead, arsenic and other toxic and carcinogenic elements may be leaching from some two dozen Superfund sites in the Houston area.

    Porfirio Villarreal, a spokesman for the Houston Health Department, said the hazards of the water enveloping the city were self-evident.

    “There’s no need to test it,” he said. “It’s contaminated. There’s millions of contaminants.”

    HE SAID HEALTH OFFICIALS WERE URGING PEOPLE TO STAY OUT OF THE WATER IF THEY COULD, although it is already too late for tens of thousands.

    “WE’RE TELLING PEOPLE TO AVOID THE FLOODWATER AS MUCH AS POSSIBLE.

    Similar caution just led the University of Houston to change the name of its Calhoun Lofts dorm because it shares a name with the 19th-century vice president and white supremacist John C. Calhoun, even though, a university spokeswoman told the Houston Chronicle, “the residence hall was not named in recognition of John C. Calhoun” but a nearby street.

    In Atlanta, likewise, protesters last week attempted to tear down that city’s Peace Monument, apparently mistaking it for a Confederate shrine. The sculpture was erected to honor those who worked for reunification during Reconstruction.

    The movement to remove Confederate monuments can be a healthy one, if done legally, according to the wishes of local citizens and in such a way that preserves this history without glorifying it. But from across this great land come reminders that nothing in America succeeds like excess.

    New York Mayor Bill de Blasio announced a 90-day review of any statues on city property that could be “symbols of hate.” New Yorkers are now taking aim at the Christopher Columbus statue in Columbus Circle and the tomb of Ulysses S. Grant.

    Some object to the Theodore Roosevelt statue outside the Museum of Natural History, and others suggest the name “New York” itself may have to go because the Duke of York was a slave trader. New York chef Tom Colicchio dropped the name of his new restaurant because it was named after a building that was named after 19th-century publishers who had racist views.

    There’s a movement in Massachusetts to rename Boston’s Faneuil Hall, cradle of the Revolution, because the 1742 structure was built by a slave trader and owner, Peter Faneuil. Residents of Philadelphia and Seattle, not to be left out, want to remove statues of, respectively, Frank Rizzo and Vladimir Lenin.

    Some may see this as a pell-mell rush to replicate George Orwell’s “1984,” in which “every statue and street and building has been renamed.” But I don’t think it goes far enough.

    If we are to purge ourselves of Robert E. Lee (and ESPN’s Robert Lee) we must avoid confusion by renaming or replacing all things with names similar to the Confederate general’s: Bruce Lee, Tommy Lee, Spike Lee, Harper Lee, Bobby Lee, Lee jeans, Lee Majors and Lee Iacocca.

    It won’t do simply to rename schools named for the Confederate Gen. J.E.B. Stuart. We’re going to have to rename Stuart Little, Stuart the Minion from “Despicable Me,” Jon Stewart, Martha Stewart and Jeb Bush. All statues of Jubal Early must come down. So must all things that share names with this Confederate general: early-bird specials, early morning, early retirement, early voting and early NBA-draft entry.

    If Confederate hero Nathan Bedford Forrest must go, so must the Redwood forest. Also the Gulf Stream waters. Fort A.P. Hill, an army base named for a Confederate general, must be renamed. So must Capitol Hill, Beacon Hill, Nob Hill, Bunker Hill, the Sugarhill Gang, Blueberry Hill, and Bill and Hill.

    Let us dispense with Jefferson Davis, by all means — but take with him Miles Davis, Sammy Davis Jr., Davis Love, the Davis Cup, the University of California at Davis, the Jefferson Hotel, Thomas Jefferson, George Jefferson, Louise “Weezy” Jefferson, Jefferson Pierce (Black Lightning) and especially Jefferson Beauregard Sessions, who also shares a name with Confederate Gen. P.G.T. Beauregard. Now that New Orleans has taken down its Beauregard statue, we’re also going to have to relocate Bo Jackson, Bo Derek and Bo Diddley.

    Memorials to Confederate Gen. Leonidas Polk cannot be moved without also erasing all trace of President James Polk, polka dances, polka dots, Hawaiian poke and Pokémon. Picket lines must be outlawed and picket fences flattened to avoid honoring Gen. George Pickett, and I will stonewall any attempt to disappear Gen. Thomas Jackson without also renaming Michael Jackson, Janet Jackson, Reggie Jackson, Percy Jackson, Action Jackson and Jackson Hole.

    I regret to say we must also rename my Washington Post colleague Philip Rucker, who shares a name with (though is not related to) Confederate Gen. Edmund Rucker.

    That’s asking a lot of Phil, but we all must do our share. I will be demanding a new name for my public high school, Calhoun High School. It’s not named for John C. but for Sanford H., a 20th-century New York school administrator who, to the best of my knowledge, did not own slaves. But you can’t be too careful.

    The J-1 Exchange Visitor Program was created in 1961 as part of the Fulbright-Hayes Act, a public law written to “INCREASE MUTUAL UNDERSTANDING BETWEEN THE PEOPLE OF THE UNITED STATES AND THE PEOPLE OF THE OTHER COUNTRIES THROUGH EDUCATIONAL AND CULTURAL EXCHANGES.” The U.S. Department of State has authority over the J-1 program.

    Under the Fulbright-Hays Act, the exchanges under the supervision of the Fulbright Scholarship Board were further extended geographically. BY 1971, THERE WAS SOME FORM OF ACADEMIC EXCHANGE WITH 100 COUNTRIES. Today, Fulbright operates in over 155 countries in all world regions.

    SEP 4, 2015 – A new report by the VA Office of Inspector General (OIG)  confirmed whistleblower claims that 300000 veterans may have died while waiting for health care – one veteran waited for …

    The IG investigation focused on Veterans Health Administration’s Health Eligibility Center. This is part of the Chief Business Office that also manages fee basis, non-VA health care. The reported concluded the Chief Business Office has no effectively manages its business processes and data systems to ensure accuracy of data within the Enrollment System.

    This failure resulted in 307,000 entries for pending requests for health care where Social Security showed that the veteran died. Due to convenient limitations with how VA tallies various numbers, VA OIG was unable to conclusively determine if those 307,000 claims were also waiting for health care benefits

    The VA OIG press release reads in part:

    OIG also substantiated that pending records included entries for over 307,000 individuals reported as deceased by the Social Security Administration. Again because of data limitations, we could not determine how many pending records represent veterans who applied for health care benefits. We also substantiated that employees incorrectly marked unprocessed applications as completed and possibly deleted 10,000 or more transactions over the past 5 years. Information security deficiencies, such as the lack of audit trails and system backups, limited our ability to review some issues fully and rule out data manipulation. Finally, we substantiated that the HEC identified over 11,000 unprocessed health care applications and about 28,000 other transactions in January 2013. This backlog developed because the HEC did not adequately manage its workload and lacked controls to ensure entry of its workload into the enrollment system.

    Abstract:

    The book’s main objective is to explore the process by which high-ranking political executives and bureaucrats interact with each other in Washington. Political executive officers are supposed to guide and control, rather than merely reflect, the various interests in the executive branch. However, they are ill-suited to do so: they come to power being strangers and amateurs. Heclo studies the relationship between executives (presidential appointees) and bureaucrats (civil servants). The former are interested in political control, and the latter in policy continuity.

    Question:

    General research question: Can politicians guide what government does by controlling the people who do it? To what extent does appointment power make political control of the bureaucracy possible?

    • What are the implications of the politicization of the bureaucracy for political control (as embodied in political executives) and bureaucratic autonomy (as embodied in high-level civil servants) within the executive branch?
    • How do political executives (interested in political control) and bureaucrats (interested in administrative continuity, bureaucratic autinomy) interact with each other in Washington?

    Answer:

    High ranking civil servants strike a balance between the demands of political executives and bureaucrats. Bureaucracies pit the ambitions and plans of career bureaucrats against those of political appointees, who are at an organizational and informational disadvantage. Because the process of career advancement of high-ranking civil servants has been politicized, they may balance the demands of political executives and bureaucrats.

    High ranking career officials who are part of a civil service system add a third dimension to the interaction between political executives and bureaucrats. They are supposed to be responsive to the legal authority of political heads, but they also have institutional responsibilities and a longer time horizon than the political heads. “The civil service idea in Washington may be a counterpoint for balancing strictly political and bureaucratic demands, but it rests on slippery foundations” (32).

    Political executives can usually do better by evoking conditional cooperation rather than invoking their authority. (220) Conditional cooperation comes from developing trust with civil servants, building alliances within the agency and outside the agency (interest groups, media, other agencies, administration), and choosing strategically which goals to pursue.

    Place in the Literature:

    Sides with Seidman (1998), Neustadt (1960) regarding the power of the presidency and the constraints imposed by the internal structure of the executive. Does not address the issue of congressional dominance directly (thus, neither confirms nor denies). Discussion of “marrying the natives” suggests some degree of bureaucratic independence.

    General Argument:

    • Presidential campaigns do not produce action programs that can be precisely legislated and then put into play by the bureaucracy.
    • Transition teams are likely to be poorly organized and political appointments (and the movements of their bureaucratic counterparts) are made after the fact.
    • Therefore, these decisions are made in haste under incomplete information. Under these circumstances, it is reasonable to believe that executives will use criteria on which information is available (i.e. political affiliation and service to the party or its members) as a basis for decision-making.
    • Higher-level staffing decisions, even within the civil service, become de facto political appointments (with political attachments to both the executive and relevant congressional actors, i.e. subgovernments and iron triangles).
    • Relationship of top civil servants and political appointees is therefore “smudgy,” i.e. not well defined. Because this relationship is not well defined, there is an absence of political and policy leadership within the bureaucracy. Political appointees “go native,” undermining presidential control, while bureaucrats are increasingly controlled by elected officials.
    • For this reason, policy implementation within the bureaucracy is not characterized by rational, hierarchical modes of interaction, but rather by establishing cooperation. This occasions the development of strategic planning and support-coalition formation.
      • The original purpose of the civil service is undermined.
      • Principal-agent relations are not clearly established and information is not efficiently disseminated.

    Suggested shape of reform:

    The establishment of a senior civil service (called Federal Executive Officers) in which rank is attached to individuals, not to jobs (unclear how this would bring about more predictable relationships between bureaucrats and political appointees, although it would make for the routinization of the post-filling process).

    Methodology: Interviews with 200 civil servants and political appointees from different departments and at different career stages.
