    Map released in support of Wild Olympics campaign; two outdoor retailers touting Peninsula’s nature, recreation

    Two popular outdoor clothing retailers are encouraging their customers to visit the Olympic Peninsula and support the Wild Olympics campaign.

    REI and Patagonia are promoting the Wild Olympics campaign at REI Seattle and online, encouraging customers to experience the diverse nature and outdoor recreation available on the North Olympic Peninsula.

    THE CAMPAIGN SUPPORTS THE PROPOSED WILD OLYMPICS WILDERNESS AND WILD & SCENIC RIVERS ACT, WHICH WAS REINTRODUCED LAST YEAR BY U.S. SEN. PATTY MURRAY, D-SEATTLE, AND U.S. REP. DEREK KILMER, D-GIG HARBOR.

    The bill would permanently protect more than 126,000 acres of new wilderness areas in Olympic National Forest and 19 Olympic Peninsula rivers and their tributaries as Wild and Scenic Rivers — the first ever on the Peninsula.

    Initiative’s shaping

    The effort comes out of a process involving local communities, businesses and economic leaders of the Olympic Peninsula who helped shape the initiative, organizers said.

    “For those of us that live on the Peninsula, we know about the natural beauty,” said state Rep. Steve THARINGER, A SEQUIM DEMOCRAT who represents the 24th Legislative District. “That’s the advantage of living here.

    “You can choose to walk on the spit or go up in the hills and walk in the Olympics. There’s a lot of folks that don’t know the variety we have here.”

    The North Olympic Timber Action Committee has been looking for a compromise to the legislation for the past several years that would help support the timber industry, said Carol Johnson, executive director.

    NOTAC substantially agrees with the concept of the proposal but wants to remove areas that are routinely logged, she said.

    “What we said is, make some adjustments to the proposal and bring into the plan a timber base that is routinely roaded,” she said.

    “Make that part of the plan so we can have a sustainable harvest level in perpetuity and have our support.”

    Connie Gallant, chair of the Wild Olympics, called the partnership with REI and Patagonia exciting.

    “It is our hope that legislation happens in the near future because it will benefit our economy and environment a great deal,” she said.

    Outdoor recreation groups REI and Patagonia unveiled a new “Destination Wild Olympics” map, highlighting some recreation places in the Wild Olympics proposal.

    The map highlights some spots on the North Peninsula that locals will know well, including the Dungeness River, Dungeness Spit, Sol Duc River, Sol Duc Falls Trail and local rivers.

    THARINGER SAID one of the goals is to get more people outside the area enjoying the nature that is offered on the Peninsula.

    “It’s a way to highlight the beauty and the wilderness in the park,” he said.

    “When folks are searching on the internet for things to do outside, you’ll never know what will trigger their interest.”

    Port Angeles City Councilwoman SISSI BRUCH SAID she supports the new initiative.

    “The idea of encouraging people who love the outdoors to come to our pristine wilderness areas while supporting their preservation has great synergy,” she said.

    “This, in concert with Port Angeles’ designation as the second-best outdoor town, validates Port Angeles’ status as a world-class outdoor recreation destination and speaks highly of our need to protect this unique and pristine environment.”

    The campaign comes from lawmakers and the outdoor clothing companies’ desires to protect and promote the outdoors, Tharinger said.

    ‘Promoting the outdoors’

    “I served on a GOVERNOR’S TASK FORCE with people from REI, and they are interested in promoting the outdoors,” he said.

    “I think it’s a synergy between PATAGONIA, REI AND THE FOLKS INTERESTED IN GETTING THE LEGISLATION PASSED THROUGH CONGRESS.”

    THARINGER SAID there is concern about the designations regarding logging but that he doesn’t see an impact to the commercial logging industry.

    “Making these designations is not going to impact the timber supply, but it does bolster the tourist industry,” he said.

    Free hard copies of the map will also be available at REI retail outlets in the Puget Sound area.

    It is a society that resembles a group of collectors of empty bottles in which there are more collectors than bottles to be found. We are not talking about a minor and insignificant sociological fact but rather an alarming one! We are talking about a poor society, a wretched and almost declassed middle class, mighty oligarchy or profiteers from war and economic transition being regarded as new pillars of society. Features of such society lost in political macrocosm of the EU (Eurosphere) include inefficient and slow public administration, high unemployment rate (in April 2015 it amounted to 17.5% or 310 936), mass emigration of younger population (around 48 000 recently emigrated) with European Comission forecast stating that 166-217 thousand of the most educated will leave the country in seven years from now on. It is a society sentenced to demographic deterioration and disappearance unless dystopian tendencies finally stop. Meanwhile prominent politicians holding executive power communicate poorly or not at all. This relates to the lack of communication from the PM and the president as well as irrational discussions on historical issues without any willingness and wish to move toward the future.

    What’s going on with the FBI criminal investigation with Hillary Clinton’s illegal use of a home email server? The FBI has been quiet, but now we have learned it’s for good reason! As sources inform Fox News’ Catherine Herridge (below), Hillary Clinton is about to be in serious trouble!

     As Rep. Mike Pompeo, who sits on the House Intelligence Committee, told Fox News:

    “I can assure you the intelligence committee is working on determining the scope of any breaches that may have resulted from the improper handling of classified information, and the damage assessments that go with them. I think we all understand that we had classified information in channels that weren’t secure on Secretary Clinton’s homebrew server and that risk was associated with that.”

    Then, Herridge explains how her sources are focused on how “federal regulations require damage assessments after classified information is outside secure government channels, such as a personal server.”

    Therefore, if Pompeo is correct, then the FBI is focused on determining internally what classified information was mishandled… Which it clearly was, as the documents included more than 22 emails that were “top secret and above.” Once that is investigation is complete, the FBI will have no other choice but to go after Hillary Clinton.

    Meaning of “High Crimes and Misdemeanors”

    The question of impeachment turns on the meaning of the phrase in the Constitution at Art. II Sec. 4, “Treason, Bribery, or other high Crimes and Misdemeanors”.

    I have carefully researched the origin of the phrase “high crimes and misdemeanors” and its meaning to the Framers, and found that the key to understanding it is the word “high”. It does not mean “more serious”. It refers to those punishable offenses that only apply to high persons, that is, to public officials, those who, because of their official status, are under special obligations that ordinary persons are not under

    and which could not be meaningfully applied or justly punished if committed by ordinary persons.

    Under the English common law tradition, crimes were defined through a legacy of court proceedings and decisions that punished offenses not because they were prohibited by statutes, but because they offended the sense of justice of the people and the court. Whether an offense could qualify as punishable depended largely on the obligations of the offender, and the obligations of a person holding a high position meant that some actions, or inactions, could be punishable if he did them, even though they would not be if done by an ordinary person.

    Offenses of this kind survive today in the Uniform Code of Military Justice. It recognizes as punishable offenses such things as perjury of oath, refusal to obey orders, abuse of authority, dereliction of duty, failure to supervise, moral turpitude, and conduct unbecoming. These would not be offenses if committed by a civilian with no official position, but they are offenses which bear on the subject’s fitness for the duties he holds, which he is bound by oath or affirmation to perform.

    Perjury is usually defined as “lying under oath”. That is not quite right. The original meaning was “violation of one’s oath (or affirmation)”.

    The word “perjury” is usually defined today as “lying under oath about a material matter”, but that is not its original or complete meaning, which is “violation of an oath”. We can see this by consulting the original Latin from which the term comes. From An Elementary Latin Dictionary, by Charlton T. Lewis (1895), Note that the letter “j” is the letter “i” in Latin.

    By Art. II Sec. 1 Cl. 8, the president must swear: “I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States.” He is bound by this oath in all matters until he leaves office. No additional oath is needed to bind him to tell the truth in anything he says, as telling the truth is pursuant to all matters except perhaps those relating to national security. Any public statement is perjury if it is a lie, and not necessary to deceive an enemy.

    When a person takes an oath (or affirmation) before giving testimony, he is assuming the role of an official, that of “witness under oath”, for the duration of his testimony.

    That official position entails a special obligation to tell the truth, the whole truth, and nothing but the truth, and in that capacity, one is punishable in a way he would not be as an ordinary person not under oath. Therefore, perjury is a high crime.

    An official such as the president does not need to take a special oath to become subject to the penalties of perjury. He took an oath, by Art. II Sec. 1 Cl. 8, to “faithfully execute the Office of President of the United States” and to “preserve, protect and defend the Constitution of the United States” to the best of his ability. While he holds that office, he is always under oath, and lying at any time constitutes perjury if it is not justified for national security.

    Independent Counsel Kenneth Starr erred in presenting in his referral only those offenses which could be “laid at the feet” of the president. He functioned like a prosecutor of an offense against criminal statutes that apply to ordinary persons and are provable by the standards of “proof beyond a reasonable doubt”. That is not to say that such offenses are not also high crimes or misdemeanors when committed by an official bound by oath. Most such offenses are. But “high crimes and misdemeanors” also includes other offenses, applicable only to a public official, for which the standard is “preponderance of evidence”. Holding a particular office of trust is not a right, but a privilege, and removal from such office is not a punishment. Disablement of the right to hold any office in the future would be a punishment, and therefore the standards of “proof beyond a reasonable doubt” would apply before that ruling could be imposed by the Senate.

    It should be noted, however, that when an offense against a statute is also a “high crime or misdemeanor”, it may be, and usually is, referred to by a different name, when considered as such. Thus, an offense like “obstruction of justice” or “subornation of perjury” may become “abuse of authority” when done by an official bound by oath. As such it would be grounds for impeachment and removal from office, but would be punishable by its statutory name once the official is out of office.

    An executive official is ultimately responsible for any failures of his subordinates and for their violations of the oath he and they took, which means violations of the Constitution and the rights of persons.

    It is not necessary to be able to prove that such failures or violations occurred AT HIS INSTIGATION OR WITH HIS KNOWLEDGE, to be able, in Starr’s words, to “lay them at the feet” of the president. It is sufficient to show, on the preponderance of evidence, that the president was aware of misconduct on the part of his subordinates, OR SHOULD HAVE BEEN, and failed to do all he could to remedy the misconduct, including termination and prosecution of the subordinates and compensation for the victims or their heirs.

    The president’s subordinates include everyone in the executive branch, and their agents and contractors. It is not limited to those over whom he has direct supervision. He is not protected by “PLAUSIBLE DENIABILITY”. He is legally responsible for everything that everyone in the executive branch is doing.

     

    Therefore, the appropriate subject matter for an impeachment and removal proceeding is the full range of offenses against the Constitution and against the rights of persons committed by subordinate officials and their agents which have not been adequately investigated or remedied.

    The massacre at Waco, the assault at Ruby Ridge, and many, many other illegal or excessive assaults by federal agents, and the failure of the president to take action against the offenders, is more than enough to justify impeachment and removal from office on grounds of dereliction of duty.

    To these we could add the many suspicious incidents that indicate covered up crimes by federal agents, including the suspicious deaths of persons suspected of being knowledgeable of wrongdoing by the president or others in the executive branch, or its contractors.

    The impeachment and removal process should be a debate on the entire field of proven and suspected misconduct by federal officials and agents under this president, and if judged to have been excessive by reasonable standards, to be grounds for removal, even if direct complicity cannot be shown.

    FEMA Federal Emergency Management Agency as an independent agency (1979–2003)

    FEMA WAS ESTABLISHED UNDER THE 1978 REORGANIZATION PLAN NO. 3, AND ACTIVATED APRIL 1, 1979, BY PRESIDENT JIMMY CARTER IN HIS EXECUTIVE ORDER 12127.

    In July, Carter signed Executive Order 12148 shifting disaster relief efforts to the new federal-level agency. Federal Emergency Management Agency FEMA absorbed the Federal Insurance Administration, the National Fire Prevention and Control Administration, the National Weather Service Community Preparedness Program, the Federal Preparedness Agency of the General Services Administration and the Federal Disaster Assistance Administration activities from HUD.

    FEMA WAS ALSO GIVEN THE RESPONSIBILITY FOR OVERSEEING THE NATION’S CIVIL DEFENSE, A FUNCTION WHICH HAD PREVIOUSLY BEEN PERFORMED BY THE DEPARTMENT OF DEFENSE’S DEFENSE CIVIL PREPAREDNESS AGENCY.

    In 1993, President Bill Clinton appointed James Lee Witt as FEMA Director.

    In 1996, the agency was elevated to cabinet rank. This was not continued by President George W. Bush. Witt initiated reforms that would help to streamline the disaster recovery and mitigation process.

    The end of the Cold War also allowed the agency’s resources to be turned away from civil defense to natural disaster preparedness.

    After Federal Emergency Management Agency FEMA’s creation through reorganization and executive orders, Congress continued to expand Federal Emergency Management Agency FEMA’s authority by assigning responsibilities to it.

    Hurricane Katrina in 2005 demonstrated that the vision of further unification of functions and another reorganization could not address the problems FEMA had previously faced. The “Final Report of the Select Bipartisan Committee to Investigate the Preparation for and Response to Hurricane Katrina”, released February 15, 2006, by the U.S. Government Printing Office, revealed that federal funding to states for “all hazards” disaster preparedness needs was not awarded unless the local agencies made the purposes for the funding a “just terrorism” function.

    Emergency management professionals testified that funds for preparedness for natural hazards was given less priority than preparations for counter terrorism measures. Testimony also expressed the opinion that the mission to mitigate vulnerability and prepare for natural hazard disasters before they occurred had been separated from disaster preparedness functions, making the nation more vulnerable to known hazards, like hurricanes.

    Organization

    During the debate of the Homeland Security Act of 2002, some called for FEMA to remain as an independent agency. Later, following the failed response to Hurricane Katrina, CRITICS CALLED FOR FEMA TO BE REMOVED FROM THE DEPARTMENT OF HOMELAND SECURITY.

    TODAY FEMA EXISTS AS A MAJOR AGENCY OF THE DEPARTMENT OF HOMELAND SECURITY. THE ADMINISTRATOR FOR FEDERAL EMERGENCY MANAGEMENT REPORTS DIRECTLY TO THE Secretary of Homeland Security.

    IN MARCH 2003, FEMA JOINED 22 OTHER FEDERAL AGENCIES, PROGRAMS AND OFFICES IN BECOMING THE DEPARTMENT OF HOMELAND SECURITY. The new department, headed by Secretary Tom Ridge, brought a coordinated approach to national security from emergencies and disasters – both natural and man-made.

    FEMA manages the National Flood Insurance Program. Other programs FEMA previously administered have since been internalized or shifted under direct DHS control.

    FEMA is also home to the National Continuity Programs Directorate (formerly the Office of National Security Coordination). ONSC was responsible for developing, exercising, and validating agency wide continuity of operations and continuity of government plans as well as overseeing and maintaining continuity readiness including the Mount Weather Emergency Operations Center. ONSC also coordinated the continuity efforts of other Federal Executive Agencies.

    FEMA began administering the Center for Domestic Preparedness in 2007.

    Washington, DC – Today, on World Water Day, Ranking Member of the Energy and Natural Resources Committee U.S. Senator Maria Cantwell (D-Wash.) released a white paper to advance the development of a 21st century national framework for addressing drought and water security in the United States.

    An unprecedented drought last year and 15 years of drought across the American West have demonstrated the need to rethink U.S. water management in the 21st century. Since 1980, droughts have cost the United States more than $200 billion. The drought last year caused widespread and serious impacts for communities, agriculture, industry and the environment. As drought is predicted to continue in the coming years and as communities throughout the United States face significant water-security challenges, it is a crucial time to evaluate and develop new strategies at the national level.  

    Sen. Cantwell’s paper lays out a national framework to address water challenges through the modernization of federal programs to support and finance sustainable, watershed-scale solutions; advance science and technology; and promote partnerships with communities. The purpose of the paper is to foster a public dialogue and to develop a comprehensive policy agenda to address national drought and water security needs, as called for by states, tribes, local governments, utilities, agricultural producers and conservation groups.

    Modernizing federal programs is critical to supporting a more water-secure future,” Sen. Cantwell said. “The Yakima water bill is a national model for watershed management. The federal government has a responsibility to act now to support these efforts.”

    The framework document reflects lessons learned from Washington’s Yakima River Basin, where an extraordinary collaboration has led to a watershed planning effort that has become a national model. Last year, Sen. Cantwell introduced the Yakima Basin bill (S. 1694) to authorize federal participation in this effort, which will help usher in a new era in water management. The bill will help to restore ecosystems and endangered species, conserve water and provide water security for families, fish and farmers for years to come. Last month, Deputy Secretary of the Department of the Interior Michael Connor called the Yakima process a model not only for working through water challenges, but any natural resource management challenge.

    The white paper released today builds on that approach and outlines five policy principles as a national framework for drought and water security:

    1. Supporting collaborative watershed-scale solutions that are locally-driven. Governance solutions should support and incentivize collaborative, locally driven, watershed solutions by modernizing, coordinating, and streamlining federal programs to make them more effective.

    2. Financing solutions through partnerships and streamlined federal funding. Innovative water financing solutions should utilize an integrated watershed funding approach that streamlines federal funding and increases opportunities for public-private partnerships.

    3. Using and advancing the best science, technology and tools. Science and technology solutions should focus on accelerating innovation and the advancement of tipping points in science, technology and tools to transform water management.

    4. Advancing sustainable water supply solutions for people and the environment. Water supply solutions should take an integrated, portfolio approach that balances the needs of both people and the environment, including: (1) increased use of water markets, efficiency, conservation, recycling, reuse and desalination; (2) improvements in existing infrastructure, operations and low-impact infrastructure (such as aquifer storage and recovery); and (3) nature-based solutions and restoration of ecosystems and fisheries.

    5. Partnering with Tribal Nations, Arctic and Island Communities. The federal government should partner with and support Tribal Nations, Arctic and Island communities as they face unique challenges in responding to and addressing long-term water security needs.

    Addressing long-term drought is also a priority for the Obama administration. Ahead of today’s White House Water Summit, the administration released a presidential memorandum to institutionalize the National Drought Resilience Partnership (NDRP), which seeks to reduce the vulnerability of communities to the impacts of drought.

    How does drought response relate to climate preparedness?

    • The President’s Climate Action Plan: In June 2013, President Obama released his Climate Action Plan to cut the carbon pollution that causes climate change and affects public health, including increased risk of drought wildfires.
    • Executive Order – Preparing the United States for the Impacts of Climate Change: On November 1, 2013, President Obama established a Task Force on Climate Preparedness and Resilience to advise the Administration on how the Federal Government can respond to the needs of communities nationwide that are dealing with the impacts of climate change, including drought and wildfires.

    In 1803, the year of the Louisiana Purchase, President Jefferson wrote a letter to William Henry Harrison, a future U.S. President who was then governor of the Indiana Territory, explaining what should be done with the Native Americans inhabiting the wild frontier.
    Jefferson went on to explain:

    “When they (the Indians) withdraw themselves to the culture of a small piece of land,
    they will perceive how useless to them are their extensive forests,
    and will be willing to pare them off from time to time in exchange for necessaries for their farms and families.

    Despite wetter-than-average weather in California, some farmers are looking at another year of a zero federal water allocation even as the billions of gallons of water continue to be dumped into the ocean in order to save a three-inch fish.
    The worst part for many lawmakers at Wednesday’s House subcommittee hearing is that the Delta smelt remains as vulnerable as ever after the loss of 1.4 trillion gallons of water since 2008 under the federal Endangered Species Act.

    Stewart & Jasper Orchards v. U.S. Fish and Wildlife Service
    Issue: Representing several California farmers, PLF attorneys are challenging the biological opinion (BiOp) by federal agencies used to restrict water deliveries from the Sacramento-San Joaquin Delta in order to protect the Delta smelt, a small fish listed under the Endangered Species Act. In 2012, PLF previously sought Supreme Court review of the case on a Commerce Clause challenge because smelt are in intrastate species, but the High Court denied cert. With a recent adverse ruling at the Ninth Circuit on the biological opinion, it sets up reconsideration of the Supreme Court’s TVA v.     An Open Letter to Presidential Candidates from Josephine County, Oregon

    TO: Candidates running for President of the United States

    This letter is to inform you of the struggles faced by the people of Josephine County, Oregon, due to ongoing problems with the federal government’s control of our public land, including our once-productive forests. Bad policies and misguided management by federal agencies such as the Environmental Protection Agency, U.S. Forest Service and the Bureau of Land Management, have left our rural county economically and socially devastated.

    I hope that you, as candidates for President of the United States, will seriously consider why the effort to transfer the ownership and control of public lands back to western states, like Oregon, is so critical to our survival.
    I am from Josephine County, Oregon.
    Because of federal land-taking, we now have a broken county with a median household income less than the State of Mississippi. My father owned a sawmill here in the 1940’s; anyone who wanted to work could easily find a job. In the 1960’s, Josephine County had 53 sawmills; the revenue for Public Safety was around $18 million per year. Josephine County, Oregon, has relied on the use of our natural resources for Public Safety, Education, and necessary Public Projects. We now live under the constant threat of having to close the jail; and this July we will receive our last congressional subsidy of $4.3 million. Use of our resources has declined to the point that we are now an impoverished county largely dependent on welfare and government social services.
    Earlier this month—the last remaining sawmill in our county closed indefinitely because they could not get enough logs to fill orders. We’ve gone from 19 sheriff’s patrols to a budget for only three patrols by this summer. Our County government laid off 127 people in 2012; 90 of those people were in the Sheriff’s Department.

    All promises from the Federal government to Josephine County have been broken. The government has not honored its commitment in the 1937 O&C Act, and the Bureau of Land Management and the Forest Service have incrementally reduced the timber harvests for two decades.

    The BLM and Forest Service close vital roads throughout the county, so that we can’t put out forest fires. Those agencies then refuse to let us log the burnt areas and derive some income from the catastrophe.

    Management of our lands by Washington, DC, has proved to be a disaster to our county, both in terms of revenue for necessary services and in terms of modern forest management practices for sustainability.

    The EPA runs roughshod over our private and public lands; overly-zealous environmental activists derive much of their income from government grants. Environmental groups consistently portray logging as environmentally-destructive “clear-cutting”, when in fact, timber companies in Oregon are well-known for responsible, sustainable forest management.

    With this loss of use of our land to generate revenue and provide jobs, come many of the predictable social problems, as indicated below: drug abuse, health problems, rise in student dropout rates, children living in poverty, increased homelessness, and reliance on welfare subsidies.

    This is the result of not having control and benefit of our county land.
    Poverty in Josephine County has reached the point that we cannot pass a property tax levy to fund public safety. Having barebones public safety negatively impacts our ability to retain and attract businesses and qualified workers.

    We would appreciate having the support of our presidential candidates for the transfer of our lands from federal mismanagement.

    We need your help to prevent further loss and to reverse the losses that have plunged our county into poverty.

    No matter which candidate emerges from the Presidential race, we will be looking to support the candidate who will be in favor of transferring the control of public lands to the states. If you want to restore the promise of America, start with Josephine County and help us help ourselves.

    IMPORTANT FACTS
    Josephine County, Oregon, population: 84,000 Area: 1,642 sq. miles
    68% of Public Land is controlled by the Federal Government

    –Outmigration of younger population, who cannot find work.
    –Influx of seniors, largely from out-of-state, attracted by the low property tax ($.58 per thousand in the county, outside the City of Grants Pass).
    -24% of the county population is over 65 years old.
    -30% of children in Josephine County live in poverty; 20% of adults 18-64 live below the poverty line.
    -65% of the children eligible for free/reduced cost lunches.

    Increased homelessness and reliance on welfare subsidies.
    Drug abuse – #1 in Oregon for Rx drug abuse (seniors selling Opioids to supplement income). Rampant heroin, methamphetamine drug use. Approximately 125 babies born each year at hospital with drug addiction.
    High school dropouts – 30-36% dropout rate throughout county. Misuse of funds allocated to school district. Dropout rate has not changed in 30 years.
    Unemployment – 11%, estimated to be 20% in 18-30 age group. Rise in young people working part-time and growing marijuana.
    Largest % employers: schools, health care, and social assistance.
