     We all know now,  So, Let’s plan on it!

    The possibilities are endless

    March 7, 2017  After looking at the 2017 plans for the new Elwha bridge, I immediately saw the possibilities and an opportunity for a Clallam County rest stop on the Norm’s Resort Property on High Way 101 next to the Elwha River.

    Who’s Norm?  What’s he got to do with it?

    In 1979  Norm’s  privately owned resort gave local citizens and tourists  FREE recreational access to 10 or more acres of private land on the bank of the Elwha River. It was great, FREE public access with a  long dirt trail for walking beside the river, free fishing,  and rental boats.

    At some point in time the Norm’s Resort property of 10 or more acres was acquired by the  government and bull dozed flat.

    With the replacement of the Elwha River bridge by WSDOT  at an estimated cost of  $18 to $25 million dollar, the opportunity and possibilities for Clallam County recreational use are endless.

    Why stop with just a Clallam County rest stop on the Norm’s Resort Property? Why not add free public recreational access a walking trail and picnic area?

    WSDOT will be tearing up the entire intersection of Highway 101 and Olympic Hot Springs Road. WSDOT will be required to do  and pay for restoration on the entire disturbed area.

    Clallam County has a history of success with the rest stop area East of Port Angeles on Highway 101.

    AND, Clallam County has a history of success, rated at four and a half stars.

     Why stop with a rest stop, walking trail and picnic area on the Elwha River?

    The possibilities and opportunity for Clallam County on nearly 50 acres previously developed recreational land are endless.

    According to the Clallam County Planning Dept map, there are nearly fifty acres (50)   of previously owned developed, public recreational land located in Clallam County. It is now owned by U.S.A. It includes the Norm’s Resort property on the East side of the Elwha River and a much larger piece of land on the West side, a Public boat launch owned by WA State,  that had locked out citizens  because of the removal of the Elwha River Dams.

    At some point in time, “THEY” combined the nearly  fifty acres of  public recreational land into one parcel  number in Clallam County.

    At some point in time  it ended up being owned by the U.S.A.  in GOVERNMENT LIMBO LAND, with four options.

    OPTION ONE (1) GIVE IT TO THE OLYMPIC NATIONAL PARK?

    The ONP has a track record  of failure, massive wash out Nov 17, 2015, Olympic Hot Springs Road emergency repairs? $4 million and they can’t even keep the road open for the gateway to the Olympics public trail access or their public view point. The National Park Service (NPS) has a $12,000,000,000.00 billion dollar backlog in maintenance.

    OPTION TWO (2) GIVE IT TO WA STATE?

    What would they do with  it?

    WA State can’t even figure out how to fund basic education.

    OPTION THREE  (3) GIVE IT TO THE TRIBES?

    The Tribes already have their fair share of tribal access on the Elwha River.

    The Clallam County, local citizens and tourists have,  FOR THE MOST PART, ZERO PUBLIC ACCESS AND ZERO PUBLIC RECREATIONAL LAND ON THE ELWHA RIVER.

    LIMBO LAND OPTION FOUR (4) GIVE IT TO OTHER.

    I am formally submitting this option four (4) request  to our Clallam county elected officials Commissioners, Bill Peach, Randy Johnson and Mark Mozias, and DCD Mary Ellen Winborn. for their review and consideration including the Road Dept. Ross Tyler P.E. and the Parks Dept.

    Clallam County has a very long history of success providing  “USER FRIENDLY” public access for local and tourist recreational facilities.

    It is submitted, based on its merit for public access and recreational opportunity  for local citizens  and Clallam Counties economic tourism value. The estimated number of tourist visiting Clallam County every year is 300,000.

    I am also sending this email to WSDOT to start the formal dialogue for coordination between Clallam County and the State of WA, in the best interest of U.S.A. everyone.

    OLYMPIC NATIONAL PARK — The Elwha River flexed its new muscles during the most recent round of storms and severely damaged Olympic Hot Springs Road and effectively buried a campground in silt.

    When the water receded, Olympic National Park officials discovered the water had washed out a 60-foot-long section of Olympic Hot Springs Road, and much of Elwha Campground had nearly disappeared under more than a foot of silt and debris, Barb Maynes, spokeswoman for the park, had said over the weekend.

    “Other areas in the [Elwha] valley have seen damage — extensive damage,” Maynes said.

    Maynes said there is no established timeline yet for repairs or reopening damaged Elwha roads and campgrounds.

    On Dec. 20, 2016, WSDOT announced that Alternatives 1-4 had been removed from further consideration. Alternatives 5, 6 and 7 are continuing to be evaluated based on public input, funding availability, environmental considerations, the condition of the existing bridge and detour routes, real estate requirements, and other factors.

    Historical Timeline of Events:
    1913 – Elwha Dam was built
    1926 – The US 101 Elwha River Bridge was built
    1927 – Glines Canyon Dam was built
    1954 – US 101 Elwha River Bridge was widened from a 20-foot bridge to 28 feet

    OCT 20, 2016  PORT ANGELES, Wash. — Officials say the U.S. Highway 101 bridge over the Elwha River could need replacement or retrofitting

    NOW THAT TWO DAMS HAVE BEEN REMOVED.

    The Peninsula Daily News reports that THE NOW-WILD RIVER is eroding the riverbed under the bridge. When state Department of Transportation crews drilled bore samples earlier this month, they learned that the bridge’s two piers sit atop gravel — not bedrock, as they had hoped.

    The bridge was built in 1926, after the Glines Canyon and Elwha dams were constructed. With THE DAMS REMOVED AS PART OF A $325 MILLION NATIONAL PARK SERVICE PROJECT TO RESTORE THE ELWHA RIVER TO ITS WILD STATE, the state has placed boulders at the base of the piers to stem erosion. But that’s just a short term fix.

    The DOT says the bridge remains safe to drive on. EXPERTS ARE MONITORING it closely to detect any movement.

    Preventive measures
    The increased water flow resulting from two dams being removed from the river have caused much material to wash downstream. Since 2012, the riverbed at the bridge has lowered 14 feet.

    The lowered riverbed revealed the piers’ seals, promoting WSDOT to do borings to verify the depth of the foundations. The borings, done in October 2016, revealed that the foundations are on gravel, not bedrock. This finding was in contrast to what the original 1926 engineering plans showed. As a result, WSDOT immediately installed over 3,300 tons of riprap (large boulders) around both piers to help prevent further erosion. Additional monitoring using tilt meters, crack meters, water flow meters, surveys and visual observations are also taking place.

    The End Result
    WSDOT is exploring several options to keep traffic moving around the Olympic Peninsula. We believe that a reliable US 101 crossing over the Elwha River is vital to the well-being of the communities on the Olympic Peninsula. To that end, we have removed Alternatives 1, 2, and 3 (options that did not include a bridge) from further consideration because they do not meet that need. Additionally, we have removed Alternative 4 (retrofitting the existing bridge) as a long-term solution due to the 90-year-old age of the structure.

    We are still evaluating the three remaining options that include building a new bridge using three different approaches. We do not have a firm timeline for a decision, but are moving forward aggressively.

    Another blizzard swept Mammoth Mountain on Wednesday, the precursor to a string of storms expected to bring up to 20 feet of fresh snow in the next 10 days, the resort says.

    Since Tuesday, 26 to 48 inches of fresh snow had fallen, with the deepest totals at the summit. Plows were working furiously to keep lots and streets clear.

    Normal resort operations could be affected as personnel struggle to deal with the snow.

    The cause of the snow? One of those “atmospheric rivers” that forecasters refer to in particularly generous storms like this. In the next week and a half, the Sierra resort is expecting three of those wet cycles.

    Excessive rain to trigger flooding, mudslides

    Cumulative rainfall into midweek could surpass a foot across the northern California coast ranges and west-facing slopes of the Sierra Nevada. Two to 8 inches of rain are expected across the Sacramento and San Joaquin valleys.

     “THE SIEGE OF STORMS HAS THE POTENTIAL TO WIPE OUT OR GREATLY ERASE THE LONG-TERM DROUGHT CONDITIONS IN THE REGION,” ACCUWEATHER SENIOR METEOROLOGIST ALEX SOSNOWSKI SAID.

    The rain will have a hard time absorbing into the soil with each passing storm. AS A RESULT, INCIDENTS OF URBAN FLOODING, RIVER FLOODING, MUDSLIDES AND ROCK SLIDES WILL ONLY INCREASE INTO MIDWEEK.

    This section of Olympic Hot Springs Road washed out in a November flood. National Park Service Director Jon Jarvis told U.S. Rep. Derek Kilmer that a one-lane bridge would be installed over the washout area in six to eight weeks.

    PORT ANGELES — Funding has been requested and plans are under review for a temporary one-lane bridge over a 60-foot washout near the Elwha Campground on Olympic Hot Springs Road.

    Once plans are approved by such agencies as the Army Corps of Engineers, National Oceanic and Atmospheric Administration, and Fish and Wildlife, construction would take from six to eight weeks, said Barb Maynes, Olympic National Park spokeswoman.

    She didn’t know when plans would be approved or when construction would begin.

    The washout has blocked access to the Elwha River Valley west of Port Angeles since November. Olympic Hot Springs Road is closed to vehicles at the Madison Falls trailhead, about a mile north of the washout itself.

    Temporary bridge

    The temporary bridge would be in place for as long as five years before a more permanent structure is built.

    The Elwha Campground, which was severely damaged in fall and winter floods, isn’t expected to be reopened this year, Maynes said.

    The National Park Service has requested emergency funds from the Federal Highway Administration to install a temporary bridge over the washout, National Park Service Director John Jarvis said last week.

    U.S. Rep Derek Kilmer, D-Gig Harbor, questioned Jarvis about the status of the road in a House Appropriations Interior Subcommittee hearing on the National Park Service budget Wednesday.

    “We’ve got a lot of private landowners and park users and research scientists and park service staff who are very heavily impacted by the loss of this single access point,” Kilmer said.

    “So I was hoping you could just discuss what the service is doing to expedite repairs to the road and ensure that access is restored as quickly as possible.”

    Said Jarvis: “We expect that to take about six weeks, six to eight weeks, to get that installed.

    “And that will serve — not great — but it will serve access to the landowners that are up that road and our own administrative access. We’ve got park housing, we have a maintenance facility up there and the public access as well.”

    Kilmer represents the 6th Congressional District, which covers the Olympic and Kitsap peninsulas and most of Tacoma.

    Maynes confirmed that a FEW  private landowners have land past the park entrance.

    Kilmer said. “We’ve got a LOT OF  private landowners and park users and research scientists and park service staff who are very heavily impacted by the loss of this single access point” “So I was hoping you could just discuss what the service is doing to expedite repairs to the road and ensure that access is restored as quickly as possible.”
    National Park Service Director John Jarvis said
    “And that will serve — not great — but it will serve access TO THE LANDOWNERS that are up that road and our own administrative access. We’ve got park housing, we have a maintenance facility up there and the public access as well.”
    “These visits do more than provide inspirational, educational and recreational opportunities; in 2014, they drove over $30 billion in economic impact, supporting hundreds of thousands of jobs in communities around the country,” he said.

    I sat down to wait for the meeting to start. I showed people the two pictures on the front page of the PDN, with the people around me. I had an real issue with Rep. Kilmer priorities, ignoring the emergency road repair for Olympic National Park tourism and instead promoting an art thing at Fort Warden?

    After a few minutes Judith called me into a side room. Rep. Kilmer and I had a 15 minute conversation on my economic concerns for our community  and his failure to prioritize  and act on the emergency flooding disaster.

    Feb 19, 2016  I did remind Rep. Kilmer, of what an  economic driver tourism is to our community.

    $424,000 request
    The park service requested $424,000 for the project, Maynes said.The temporary bridge would be expected to be in use for about five years, she said.“During those five years, we will pursue plans and funding for a longer-term fix,” she said Saturday.Since the road is in an active floodplain, “a longer-term solution will take much larger effort,” she added.

    With a five-year funding bill in place, the National Park Service will work with the highway administration to complete “a major reconstruction on that site,” Jarvis said.

    But he also said that would take years.

    “We’ll be living with that temporary fix for three to five years,” Jarvis said.

    Washed out

    The road washed out when a dry Elwha River side channel was reactivated in a Nov. 17 flood.

    A second flood that occurred Dec. 8 and Dec. 9 caused additional damage to the road and nearby Elwha Campground.

    The damage to the Elwha Campground was extreme, Maynes said.

    “Some picnic tables were moved by the force of the water. Some are buried in silt. It’s unlikely that we will be able to get that open this year,” she said.

    Altair Campground was also damaged in the Nov. 17 flood. It had been closed because of damage done in a December 2014 storm.

    “Our neck of the woods has had a really tough winter,” said Kilmer, a Port Angeles native.

    Pedestrian bridge

    A pedestrian bridge over the side channel has been replaced by a small wooden bridge that can support emergency vehicles.

    Seedlings have been planted along the banks of the surviving road sections to prevent further erosion.

    “I know you’ve been getting a lot of rain up there,” Jarvis told Kilmer.

    “At least we’re getting some snowpack, both in the Cascades, the Olympics and the Sierras this year, which is a good thing.

    “The good thing on the Elwha is that it’s helped flush out all that sediment that was backed up on the rivers,” added Jarvis, referring to the removal of the Elwha and Glines Canyon dams, a project that began in 2011.

    Kilmer described Olympic National Park as an “extraordinary asset that draws a whole bunch of people to our region.

    “I’m often reminded of just what an economic driver it is, not just in terms of hotel stays and restaurants and things like that, but my grandfather helped pave the road up Hurricane Ridge, so it’s been an extraordinary asset,” Kilmer said.

    The National Park Service system has 410 sites, including 58 national parks.

    The service has recently restored seasonal ranger hiring to peak levels, coordinated more than 400,000 volunteers, completed deferred maintenance projects and expanded partnership through a centennial program, Jarvis said.

    “All of these actions will help sustain our parks for another 100 years,” he told the committee.

    The National Park Service drew a record 307 million visitors in 2015 nationwide, Jarvis said.

    “These visits do more than provide inspirational, educational and recreational opportunities; in 2014, they drove over $30 billion in economic impact, supporting hundreds of thousands of jobs in communities around the country,” he said.

    Once Upon A Time in Olympic National Park

    THERE WAS A PRIVATE  ELWHA RIVER RECREATIONAL PARK

    “My Dad, George C. Rains Sr  developed one of the finest recreational campground facilities the Elwha River area has ever known. We subdivided and developed it into campsites with underground electricity, water system, good roads and restroom facilities.”

    And you remember what happens next, the Big Bad Wolf gobbles up the grandmother, swallows her whole and then the wolf eats Little Red Riding Hood..

    Unfortunately (133) Olympic National Park Inholder Campsites were destroyed they are listed by name and number below

    The names 133 people purchasing recreational sites and making payments between 1970-1973 are documented below.

    However the actual number of inholder’s ownership in ONP  may have been 250 or more.

    Many of the Inholder’s  that purchased and lost their Private recreational property in the Elwha River Recreational Park were local families.

    Many of the original purchasers are no longer living. Somebody needs to tell their story.

    Frankie White ended up as a NOT SO WILLING SELLER

    This is Frankie’s story given to me in a telephone conversation.

    Frankie was a single parent, she bought, made a small down payment on the recreational lot for she and her son. They spent delightful times together on the Elwha River, as much time as a working mother could afford to spend.

    When the Olympic National Park devastating flooding event started, she was offered an opportunity to sell her property to the park. Frankie still owed a lot of money on her purchase.but when she was first offered an amount of money, she said she did not want to sell, she wanted to wait and see what would happen.

    Hmmm…  Parks willing seller approach, if you sell it to us RIGHT NOW we will give you X amount if you wait until next year the offer will be reduced by $500.00.

    Frankie was afraid,  Was she bullied? Threatened? Intimidated?  Whatever…  Frankie became a NOT SO WILLING SELLER TO THE ONP for the higher amount.

The Emergency Relief for Federally Owned Roads (ERFO) program provides funds to Federal Agencies for the repair of damaged roads due to natural event. If an event has been approved for funding and the Olympic Hot Spring Road is part of event, more than likely we have provided some funds for the repairs. However, I would need more information.

    My understanding from the the Feb 8, 2016 meeting is that there are two specific hold-ups. identified as, the Army Corp of Engineers and a required NOAA consultation under section 7.
    Commissioner Bill Peach, asked if the Olympic Hot Springs Road would be open by the 4th of July?
    In response, both Lisa Turecek, PE Chief of Facilities Management and Brian Winter Elwha River Project Manager answered.
    the Army Corp of Engineers must, be given time to respond, up to 60 days? Because a 100 foot bridge must be built.
    Brian, that tentative plans to proceed shall required NOAA consultation under section 7,
    Commissioner Peach, asked When will the road be reopened to public and private access?
    Lisa’s guesstimated was four months from the time that construction was permitted to start.

    At this point in time I am asking for help from anyone that can expedite the hold-ups, repair the Olympic Hot Springs Roads and trails, and, have public access completed for the 2016 tourist season that starts in late May.
    Tourism runs our local economy, it provides income to our business’s, jobs and income to our unemployed, and food on the plates of our hungry families.

    OLYMPIC NATIONAL PARK — Crews are trying to preserve what’s left of Olympic Hot Springs Road near a massive washout in the Elwha River Valley, and Olympic National Park officials plan to provide pedestrian access through the area by the end of the month.

    “Downstream from the washout, the bank is beginning to erode near the roadway,” said Barb Maynes, park spokeswoman.

    Crews are making emergency repairs to stabilize the Elwha River bank to save parts of the road that remain, she said.

    Park crews will have to wait until the rainy season is over before they can begin repairing the gaping 60-foot section of Olympic Hot Springs Road that was washed out earlier this winter, Maynes said.

    The road is closed at the park gate at Madison Falls, 1 mile north of the washout.

    A pedestrian trail is being built to bypass the damaged and FLOOD-PRONE AREAS, and it should be open by the end of this month, she said.

    There is no set date for repairs to the road, she said, but the park hopes to have it open with temporary repairs in time for Memorial Day weekend at the end of May.

    The park was approved for a Federal Highway Administration emergency repair grant to make the temporary fixes, Maynes said.

    She said she did not know how much money the park would receive.

    A flood Nov. 17 reactivated a long-dry river channel behind the Elwha Campground, obliterating a section of Olympic Hot Springs Road and inundating the campground with silt and debris.

    A second flood Dec. 8 and Dec. 9 caused additional damage to both the road and campground.

    Engineers are working on both temporary and permanent designs that will have to meet strict environmental standards because the Elwha River is a major salmon-producing stream, Maynes said.

    Currently, park maintenance employees are accessing areas south of the washout via a temporary bridge that spans part of the gap and has to be removed every time conditions indicate the water might rise, she said.

    Park officials are trying to complete temporary repairs by Memorial Day weekend to allow visitors to access the Glines Canyon overlook, several trailheads and the Olympic Hot Springs.

    Rehabilitation plans

    Long-term repairs to the road will be part of a planned large-scale rehabilitation of the aging visitor infrastructure of Elwha Valley roads, trails and campgrounds, Maynes said.

    Park planners expect to begin taking public comment and complete environmental studies on the project in a year or two, after which the park will complete the work, which should leave the area in good shape for visitors for decades, she said.

    Hot springs reopened

    The Olympic Hot Springs — natural hot spring pools located 2.5 miles above the Boulder Creek Trailhead — have reopened.

    The pools were closed in October after Silverdale resident Bruce Gunderson was found dead in one of them.

    An autopsy performed Oct. 30 revealed that the manner of death was an accident and the cause of death was freshwater drowning.

    Park officials kept the pools closed after the death due to the possibility of health risks.

    Once the pedestrian path is established, visitors can hike or bicycle the 10-mile route to the hot springs.

    Campground fates

    Two campgrounds in the Elwha Valley are closed, and only one is likely to reopen soon.

    The silt and debris covering the Elwha Campground will have to be removed and repairs made, Maynes said.

    Once that work is done, the campground is expected to reopen sometime this summer, she said.

    The Elwha River changed its course during a December 2014 flood and removed several Altair Campground campsites as the main channel moved across its historic floodplain.

    “Most of [Altair] is gone,” Maynes said.

    The future use of the remaining portions of the campground is under consideration, she said.

    In other parts of the park, Graves Creek Road in the Quinault area remained closed to cars due to a road washout caused by the same storms that damaged Olympic Hot Springs Road.

    Access to the Enchanted Valley trailhead remains open for hikers, but with a longer walk from cars to the trailhead, Maynes said.

    Congress created the GLO in 1812. The GLO handled all public land issues, including sales, patents and land entries. Surveyors were sent out with tools of the trade to record in their notebooks all mines, salt licks, salt springs, mill sites, water courses and the quality of the lands. This information helped purchasers and homesteaders make informed decisions about the lands offered.

    Grazing Service- With westward expansion came increases in livestock
    grazing and deteriorating rangelands. Between 1870 and 1900, the number

    numbers of livestock, combined with drought in the early 1930s, set the

Bush signed legislation to allow the federal government to buy the dams and begin conducting studies regarding the feasibility of their removal.

    On Mon Feb 8, 2016 2:30PM there was a meeting  at Olympic National Park Headquarters regarding the closure of the Olympic Hot Springs Road to all public and private access. I told my story, expressed my concerns on the economic impact to the local community and asked my questions.

    Four of my government representatives listened, responded and answered questions

    Clallam County Commissioner  Bill Peach opened the door.

    As required in the ERFO guidelines, under the  program, Federal agencies and local government entities have the responsibility to perform emergency repairs, shift project and program priorities, give emergency relief work prompt attention and priority over non-emergency work, and assist the Office of Federal Lands Highway in its stewardship and oversight responsibilities.

    I was delighted to have the opportunity to meet with them face to face.

    I was delighted at the conclusion of the meeting, strictly based on my understanding of the contents of the meeting, of the expeditious actions that have been taken and will be taken in the future.

    This comment is intended to inform others, to share for the record, the information from the notes I took at the Feb 8, 2016 meeting.

    I was delight with the positive response from M. Sarah Creachbaum
    Superintendent, of the Olympic National Park.

    Sarah showed genuine concern for the economic well being of local people, she cares about the local people, they are her people.

    When I suggested that she do a news release to inform we the concerned people

    Using  the  progress reported by Lisa,  the expeditious steps taken with the  ERFO Program for the reopening the Olympic Hot Springs Road to provide access to the ONP public tourist, and private property owners.

    You know, like a message of hope from the Superintendent, of the Olympic National Park, for the economic future of  the local business people, for increased employment… for the the rush of  tourism created by the removal of the dams.

    Sarah agreed to do a press release…

    And I was delighted.

    However, after hours of more in-depth research, done after the meeting, included  in this comment,  that provides additional documentation……

    Being delighted, and staying delighted with the ONP, are two different things! This is not my first rodeo with the Olympic National Park Service.

    Indeed, if I have made unintentional errors in this comment, I will do an immediate update on this website and  a retraction immediately.

    Note It was stressed by Lisa and Brian  that the Army Corp of Engineers must, be given time, up to 60 days? Because a 100 foot bridge ( at  undisclosed location?)  must be built.

    When will the road be reopened to  public and private access?

    Lisa’s guesstimated was four months from the time that construction was permitted to start.

    I asked Flood barriers? only to protect the Elwha tribe? Flood barriers? only protect tribal land?

    I asked Brian to correct me if I was wrong.

    He did. emphatically…

    Flood barriers were provided for  the tribes and private property on the West side of the mouth of the Elwha River and And, flood barriers were provided for private homes down stream from the dam removals.

    full text Emergency Relief for Federally Owned Roads (ERFO)

    On December 4, 2015, the Fixing America’s Surface Transportation Act of 2015 (the “FAST Act” or “Highway Funding Act”) was signed into law replacing MAP-21. We are in the process of revising the information on this page to address this new legislation.

    The Emergency Relief for Federally Owned Roads Program, or ERFO Program, was established to assist federal agencies with the repair or reconstruction of tribal transportation facilities, federal lands transportation facilities, and other federally owned roads that are open to public travel, which are found to have suffered serious damage by a natural disaster over a wide area or by a catastrophic failure.

    The intent of the ERFO program is to pay the unusually heavy expenses for the repair and reconstruction of eligible facilities.

    The ERFO program is not intended to cover all repair costs but rather supplement Federal Land Management Agency (FLMA) repair programs. Repairs are classified as either emergency or permanent repairs.

    Emergency repairs are those repairs undertaken during or immediately after a disaster to restore essential traffic, to minimize the extent of damage, or to protect the remaining facilities. Prior approval is not required, however all other eligibility requirements of the program still apply.

    Permanent repairs are those repairs undertaken after the occurrence of the disaster to restore facilities to their pre-disaster conditions. Prior approval is required.

    The ERFO program provides assistance to other federal agencies whose roads meet the definition of “open to public travel” such as: Bureau of Reclamation; Department of Energy (previously under jurisdiction of the Bureau of Reclamation, i.e., owned by the Western Area Power Association); Department of Defense (Military Installation roads); and Surface Deployment and Distribution Command (Defense Access roads).

    The Federal share payable for the repair of tribal transportation facilities, federal lands transportation facilities, and public roads on federal lands is 100 percent under the ERFO Program. Funds for the ERFO Program are provided from the Highway Trust Fund and the General Fund through the Emergency Relief Program for Federal-aid Highways. ERFO funds are not to duplicate assistance under another Federal program or compensation from insurance, cost share, or any other source.

    The Office of Federal Lands Highway is responsible for efficient and effective management of public funds entrusted by Congress and for ensuring that the ERFO Program is administered consistent with laws, regulations, and policies.

    This purpose of this memorandum is to provide guidance for changes to the Emergency Relief for Federally Owned Roads (ERFO) program.

    Section 1107 of the “Moving Ahead for Progress in the 21st Century Act” (MAP-21), enactedJuly 6, 2012, amended 23 U.S.C. 125 “Emergency Relief” as follows:

    • (e) TRIBAL TRANSPORTATION FACILITIES, FEDERAL LANDS TRANSPORTATION FACILITIES, AND PUBLIC ROADS ON FEDERAL LANDS.-
      • (1) DEFINITION OF OPEN TO PUBLIC TRAVEL.-In this subsection, the term ‘open to public travel’ means, with respect to a road, that, except during scheduled periods, extreme weather conditions, or emergencies, the road is open to the general public for use with a standard passenger vehicle, without restrictive gates or prohibitive signs or regulations, other than for general traffic control or restrictions based on size, weight, or class of registration.
      • (2) EXPENDITURE OF FUNDS.-Notwithstanding subsection (d)(1), the Secretary may expend funds from the emergency fund authorized by this section, independently or in cooperation with any other branch of the Federal Government, a State agency, a tribal government, an organization, or a person, for the repair or reconstruction of tribal transportation facilities, Federal lands transportation facilities, and other federally owned roads that are open to public travel, whether or not those facilities are Federal-aid highways.
      • (3) REIMBURSEMENT.-
        • (A) IN GENERAL.-The Secretary may reimburse Federal and State agencies (including political subdivisions) for expenditures made for projects determined eligible under this section, including expenditures for emergency repairs made before a determination of eligibility.
        • (B) TRANSFERS.-With respect to reimbursements described in subparagraph (A)-
          • (i) those reimbursements to Federal agencies and Indian tribal governments shall be transferred to the account from which the expenditure was made, or to a similar account that remains available for obligation; and
          • (ii) the budget authority associated with the expenditure shall be restored to the agency from which the authority was derived and shall be available for obligation until the end of the fiscal year following the year in which the transfer occurs.

    Section 1508 of MAP-21 amended 23 U.S.C. 120 “Federal share payable” as follows:

    • (e) EMERGENCY RELIEF.-The Federal share payable for any repair or reconstruction provided for by funds made available under section 125 for any project on a Federal-aid highway, including the Interstate System, shall not exceed the Federal share payable on a project on the system as provided in subsections (a) and (b), except that-
      • (1) the Federal share payable for eligible emergency repairs to minimize damage, protect facilities, or restore essential traffic accomplished within 180 days after the actual occurrence of the natural disaster or catastrophic failure may amount to 100 percent of the cost of the repairs;
      • (2) the Federal share payable for any repair or reconstruction of Federal land transportation facilities, Federal land access transportation facilities, and tribal transportation facilities may amount to 100 percent of the cost of the repair or reconstruction;

    Effective October 1, these provisions will be implemented as follows:

    • In addition to tribal transportation facilities and Federal lands transportation facilities, other Federally owned roads that are “open to public travel”, whether or not those facilities are Federal-aid highways, are eligible for ERFO funds. This provides ERFO eligibility to Federally owned roads that may not meet the definition of a tribal transportation facility or a Federal lands transportation facility. The intent of this provision is to focus the limited ERFO funds on those facilities that are surfaced and maintained for standard passenger vehicles. Therefore, roads passable ONLY by high-clearance vehicles are not eligible for ERFO under this provision. High clearance roads no longer eligible for ERFO may be eligible for assistance under FEMA or other programs.
    • To be eligible for ERFO funding under 23 U.S.C. 125(e)(2), trails and transit systems must be included in the inventory of Tribal or Federal Lands Transportation Facilities. Trails included in the inventory should provide access to high-use recreation sites or Federal economic generators.
    • Section 125(e)(3) of title 23, United States Code, was amended to add language affecting the reimbursement to Federal Land Management Agencies (FLMAs). When FLMAs use their own funds for emergency and permanent repairs, ERFO funds can go back to the FLMAs original account or a similar account and remains available for obligation. Additionally, the budget authority shall be restored to the agency from which the authority was derived and shall be available for obligation until the end of the following fiscal year.
    • The Forest Highway program is repealed at the end of FY12. Forest Highways are no longer eligible for ERFO funding, unless they are Federally-owned roads that meet the requirements of 23 U.S.C. 125(e). Other State and local roads that do not meet the requirements of 23 U.S.C. 125(e) may be eligible under the Federal-aid Emergency Relief program or FEMA.
    • For eligible ERFO repairs accomplished more than 180 days after the occurrence of the natural disaster or catastrophic failure on facilities other than those meeting the definition of a Federal land transportation facility or tribal transportation facility, the Federal share payable shall be in accordance with 23 U.S.C. 120, including the sliding scale provision of 23 U.S.C. 120(b).
    • Federal land access transportation facilities are not eligible for ERFO funding under 23 U.S.C. 125.

    Repairs for Program of Projects (POPs) approved prior to and after October 1 will proceed under MAP-21 provisions. See FHWA Treatment of Carryover Highway Program Funding table. If you have any further questions, please contact Mr. Sergio Mayorga at 202-366-9491.
