    Discovery on the Clallam County SMP Update 2009-2017

    My DISCOVERY on the 2017 DCD SMP Update Draft  IS NOT IN CHRONOLOGICAL ORDER, It is the cumulative documents I have uncovered  and DISCOVERED over an eight year period of time. And includes recent public information requests.

    My first public meeting on the SMP Update, Jan 26, 2011 went something like this.

    Hello Country Bumpkins,  my name is Margaret Clancy, this is Jim Kramer, we are from ESA Adolfson, and we’re here to help you.

    UNFORTUNATELY, none of THE 2017 BOCC were in office in 2011, and the ones that were  in office BOCC did not attend that meeting.

    Lois, Sue and Prosecuting Attorney Mark Nichols did attend that Jan 26, 2011  meeting.

    Feb 1, 2011 my PDN published opinion “If the Clallam County SMP Update is anything like the one in Port Townsend, anybody that lives within 150 feet of a mud puddle should be concerned”

    ESA Adolfson Margaret Clancy did the SMP Update for Jefferson County.

    That was my published opinion in Feb 1, 2011  and I’m sticking with it Nov 4, 2017

    City Slickers should never underestimate the intelligence and tenacity of  Clallam County  Country Bumpkins et al.

    The Clallam County 2017 SMP Update has reached a critical point, the Planning Dept under the direction of elected DCD Director Mary Ellen Winborn, in collaboration with Ecology’s local coordinator DOE Michelle McConnel, ESA paid Facilitator Margaret Clancy and Steve Gray have approved “THEIR” 2017 SMP  Update Draft.

    The SMP Update Draft is now being examined by our ELECTED Board of Commissioners, Bill Peach (R), Randy Johnson (I) and Mark Ozias (D).

    I made as many changes as I could to the SMP, insisting that “grandfathering” stay in (it kept disappearing), not developing in tsunami zones be completely removed,  and a hundred other things.  Couldn’t make any progress on buffers, setbacks, and floodplain.  After 7 years it was time to move it off our table and let the county commissioners weigh in.  Bill Peach and I have had many conversations about SMP.

    I did go to the Public Meeting at the Senior Center last night (April 11, 2011) 5:30 to 8:30. It was where people where broken into groups based on their interest.

    Private property owner’s on the Elwha are being washed out and very concerned.

    Lakes were not on Adolfson’s /Jim Kramer’s agenda, but due to popular demand, Lake Sutherland people finally got a chance to be heard. 

    I sat in on their lake meeting. It was run by an Adolfson woman and documented by Jim from the Planning Dept. They came to a consensus regarding the 35 foot setback, repairing existing structures and public access.

    They want clarification and specific requirements on the revised SMP.

    The Adolfson woman told the group they are going to completely rewrite our SMP and we won’t even recognize it when they are done?

    AFTER EIGHT YEARS TOGETHER ON THE JEFFERSON COUNTY SMP UPDATE, ESA MARGARET CLANCY AND DOE MICHELLE McCONNELL ARE TOGETHER AGAIN, ANOTHER EXTREMELY HARD JOB, SHEPHERDING THE CLALLAM COUNTY PLANNING DEPT THRU THE CLALLAM COUNTY 2017 SMP UPDATE DRAFT.

    Michelle McConnell, who has been a stalwart at the Jefferson County Dept. of Community Development for many years, has chosen to leave and work for the Department of Ecology.

    Michelle has had the extremely hard job of shepherding the Shoreline Master Program through over the last 8 years.

    She has always been a steady hand and been a sea of calm in the midst of turbulent public meetings over the SMP. We will miss her guidance on these issues. No word on a replacement yet. Best of luck to Michelle in future endeavors.

    I’m pleased to announce I have accepted a new job and will be leaving DCD the week of April 7, 2014  my new position will be as a Shoreline Planner with WA Department of Ecology.

    Does the BOCC have enough to make a good decision about the 2017 SMP Update?  Oct 30th, 2017 was their first worksession to figure it out.  The presentation by the DCD staff is posted to the SMP website and the worksession video can be viewed at the BOCC web page.

    Great question, Will the BOCC have enough to make a good decision about the 2017 SMP Update based on presentations provided by the DCD staff? 

     I THINK NOT!

    It is my intention to provide the BOCC with enough document information on the DCD 2017 SMP Update Draft to make an informed decision for, and in the best of  all citizens of Clallam County.

Recent initiatives from Guy Carpenter and Marsh & McLennan Companies, both involving the peril of flood, demonstrate the diversity of approaches that can be brought to bear. In the United Kingdom, we are involved in a project where the insurance industry is working in concert with the government to adjust the industry’s approach to the peril of flood and maintain the private sector’s role as the source of insurance protection without a resultant increase in the public sector’s liability.

Typically these risk financing plans will also rely on retained profit, assessments and debt facilities in concert with the various forms of reinsurance to manage their exposures. The utilization of alternative risk financing capital through catastrophe bonds and/or collateralized reinsurance continues to grow with eight of 12 facilities that utilize traditional reinsurance also accessing risk transfer capacity through catastrophe bonds and/or collateralized reinsurance to help manage their loss exposures.     The Energy and Natural Resources’ Subcommittee on Public Lands, Forests and Mining will hold a hearing on Thursday, April 21 at 2:30 p.m. in Room 366 Dirksen Senate Office Building in Washington, DC.

     The purpose of the hearing is to receive testimony on the following bills:

    1. 1510 (Murray), to designate and expand wilderness areas in Olympic National Forest in the State of WASHINGTON, and to designate certain rivers in Olympic National Forest and Olympic National Park as wild and scenic rivers, and for other purposes.

       S. 1167 (Crapo), to modify the boundaries of the Pole Creek Wilderness, the Owyhee River Wilderness, and the North Fork Owyhee Wilderness and to authorize the continued use of motorized vehicles for livestock monitoring, herding, and grazing in certain wilderness areas in the State of IDAHO.

       S. 1423 (Boxer), to designate certain Federal lands in CALIFORNIA as wilderness, and for other purposes.

    • S. 1699 (Wyden), to designate certain land administered by the Bureau of Land Management and the Forest Service in the State of OREGON as wilderness and national recreation areas and to make additional wild and scenic river designations in the State of Oregon, and for other purposes.
    • S. 1777 (Risch), to amend the Wild and Scenic Rivers Act to authorize the Secretary of Agriculture to maintain or replace certain facilities and structures for commercial recreation services at Smith Gulch in IDAHO, and for other purposes.
    • S. 2018 (Murkowski), to convey, without consideration, the reversionary interests of the United States in and to certain non-Federal land in Glennallen, ALASKA.
    • S. 2223 (Thune), to transfer administrative jurisdiction over certain Bureau of Land Management land from the Secretary of the Interior to the Secretary of Veterans Affairs for inclusion in the BLACK HILLS National Cemetery, and for other purposes.
    • S. 2379 (Flake), to provide for the unencumbering of title to non-Federal land owned by the city of Tucson, ARIZONA, for purposes of economic development by conveyance of the Federal reversionary interest to the City.
    • S. 2383 (Hatch), To withdraw certain Bureau of Land Management land in the State of UTAH from all forms of public appropriation, to provide for the shared management of the withdrawn land by the Secretary of the Interior and the Secretary of the Air Force to facilitate enhanced weapons testing and pilot training, enhance public safety, and provide for continued public access to the withdrawn land, to provide for the exchange of certain Federal land and State land, and for other purposes.

    Letter to KBC News by Mark Johnson, 4/12/16

    “Well, if I wanted all the people out of Northern California, what would I do?”
    I’d lock up all the natural resources.  I would remove all the infrastructure… like the Klamath dams.

    I would put the people on printed money heroin…and they would get addicted to transfer payments and free government services.

    After some more time went by… I’d have the Klamath National Forest in a quasi wilderness area, I’d have the loggers gone…Get rid of the pesky diggers..the mining community. I’d go after the agriculture community…attempt to eliminate them.  I’d go up stream…get rid of the 4 dams, remove the water inventory and electrical generation for 70,000 homes.  The warm nutrient rich waters from above the dams would not be cleaned by the dreaded green algae.  The nutrient rich without the dams…the water would be warmer down stream, the O2 level less…and the fish kill cycles greater, and deeper.

    Then I’d go to the Klamath Basin…and slowly, surely…eliminate the federal water projects, the potato farmers, the alfalfa farmers,

    I’d make it all a big wetlands area like before the white man.

    Then as a government… I’d be broke…my govt printed money would have no purchasing power. My debt would be so great that I would have to print money to pay the debt which equals inflation.

    The people I tricked with BIA and O and C transfer payments would have no means of support, no raw materials….and no land for wealth creation.

    Those rural people would have to migrate to the cities, or they would have to die early…. like the Native American does on the reservation system.

    Over the past 25 years over 800 dams of various sizes have been destroyed in our nation alone. That is a bit scary since one of the big differences between first and third world countries is found in the existence or absence of fully functioning dams. The politically correct World Bank had been busily financing the construction of Third World dams by the way, until there arose too much pressure from their otherwise Green allies. Truly when the ethically protected usage, flow and storage of water is harnessed by and for humankind freedom can have a tendency to abound, when combined with free markets that is. With the availability of resources as such there also comes great opportunity for individual advancement in terms of education, employment, wealth, strength, vitality, health and the pursuit of happiness. That also leads directly to the enhancement of the general fitness, financial soundness, global relevance, unity, security and wellbeing of a nation, from the bottom up.

    On the other hand if a certain sort would like to subversively take control of a nation an obvious place to begin would be to gain despotic, destructive and disruptive control over its waters. Because with that also comes authority over many other things that we can’t live without like food, wealth, jobs, electricity etc. It hasn’t gone without notice that over recent decades there have been many an alarming attempt and success in the movement to drain our citizenry and nation of its wealth, rights, freedom, future, confidence, trust of government, unadulterated history and might. Simultaneously a form of top down centralized constituency free governance has been worming its way into the political landscape of our nation and even the world.

    So, what if there really were dedicated and well funded operations in existence which work tirelessly to undermine capitalism, and with that reshape the balance of local, regional, national and global power? What if their preferred and nearly perfected disruptive mechanism is simply the oppressive manipulation of water, species, rights, equality issues, sea and land policy? What if all of this was falling into place through Marxist inspired radical political correctness and environmentalism, empowered by the tragic consensus, collaboration and support of a manipulated populace which has apocalyptically yet proudly exchanged the truth for a lie? Well, that just may be what is currently taking place near and far.

    Not too long before the seemingly treacherous and unsupported agreement to remove four Klamath River dams was signed (with blatant indifference to voter or congressional approval) it was more than a little disquieting to find out that Dan Keppen, (former head of the Klamath Water Users Association) had met with the Obama Whitehouse and United Nations associates in person to discuss water issues, water policy and resolution templates including the Klamath Basin Restoration Agreement (KBRA) etc. That time line may be coincidental, still it is important to consider how many of the KBRA collaboration buzz words are found throughout a UN report titled MANAGING WATER UNDER UNCERTAINTY AND RISK. It is quite revealing to search out (control/F) certain words in that document. There are some words and terms with a local parallel which you will quickly recognize like: STAKEHOLDERS, SUSTAINABILITY, UNSUSTAINABLE, COLLABORATE ,WATER UNCERTAINTY, JOBS, GREEN ECONOMY, BIODIVERSITY, ACCOUNTABILITY, TRANSPARENCY, RESTORATION, WATER QUALITY, POLLUTION, STATUS QUO (which is probably code for locals trying to maintain their legal, economic, citizenship and constitutional rights) INEQUALITY, EQUALITY, INDIGENOUS, LOCAL, ORGANIC, ORGANIC AGRICULTURE, BIODIVERSITY, NATURAL, SUSTAINABLE GROWTH, CLIMATE CHANGE, ADAPTIVE MANAGEMENT, MONITORING, FAIRNESS, JUSTICE, DISTRIBUTIONAL JUSTICE, GOVERNANCE (as opposed to representative government) and on and on. We have been thoroughly sound-bite-bitten by those same UN mantra bumper sticker slogans and terms around here since the beginning of the local collaborator’s stakeholder “settlement” process. It all seems to be frighteningly in sync as well with what is referred to as he UN’s Millennium Declaration and Millennium Development Goals.

    I was sad but not astonished as well to see in Keppen’s Herald and News article that he was also happy about the success enjoyed by Klamath Blue Zone programs and projects. Here too rises up the nagging fear that KBZone may be just one more local manifestation of a citizen’s Marxist Manifesto. It does make you wonder for sure when the recent H & N Blue Zone article spewed this: “A community effort …these measures may look like someone coming into town and arbitrarily telling people what they can and can’t do. But he said there comes a time when a community needs to consider how an individual’s decisions impact the entire group… Sometimes, as a society, we have to ask and answer some very hard questions about what is best for all of us…Similarly, he continued, when it comes to health, sometimes we’re going to have to make difficult choices and make individual sacrifices in favor of benefiting a larger population.” It sounds like they would also like to eventually make some UN similar choices for us: choices for our improved healthy happy alternative communal sustainable future. In the end it is all about others answering questions and making choices for us – for the greater good of the greater number of course!

    Sky Lakes Medical Center (for the greater good) is NOW telling us that it is not making Blue Zones like choices for us, yet visitors can no longer buy sugared anything on the hospital premises. It is so nice that we have so many caring people running around close to where we live making “good choices” for we dummies! We dummies who don’t know good from bad, right from wrong, evil from good and on and on. A few more Soviet style consensus councils and we just may be on our way to heaven on earth, and peace and unity without God. Until things literally and predictably go to Hell.

    So, it should go without saying that there is as usual just a whole lot at stake in the upcoming elections. Especially when one considers that no truly conservative politician could ever have anything to do with the Marxist inspired, anti-republic KBRA etc., Blue Zones or the whole mess of tax and spend Citizens for Great Sounding but Eventually Self-Destructive Stuff. At their core one must fully consider the probability that whether by naivety, greed, misdirection, foolishness or malice they share the some of the political leanings as found in the bulk of our nation’s enemies past and present. It is all a receipt for disaster.

    As we discover through inquiry and questions what the candidates are all about and where their roots are fastened, we will then have a good idea of where they are coming from and where they are trying to go, or take us. In the end don’t vote for anyone who will try to get you to agree to sacrifice what you can’t afford to lose to someone who hasn’t earned it, then take you somewhere you don’t want your family, your friends, yourself, community, city, county, state or country, or world to go, let alone become!

    Oh yes, where did that $48,000,000 is misappropriated BOR funds end up? Here’s to a certain sort of upcoming indictment.

    VA Employee Charged With Falsifying Medical Records Of Numerous Veterans

    AUGUSTA, GA: A 50-count indictment, unsealed today in federal court, has charged Cathedral Henderson, 50, a U.S. Department of Veterans Affairs (VA) employee and the former Chief of Fee Basis over non-VA Care at the Charlie Norwood VA Medical Center in Augusta, Georgia, with crimes related to his alleged falsification of the medical records of numerous VA patients. The indictment alleges that Henderson terminated unresolved consults – medical appointments that had not been scheduled or completed – by falsely stating in VA patients’ medical records that “services have been completed or patient refused services.”
    United States Attorney Edward Tarver stated, “The crimes alleged in this indictment are troubling. Our VA officials and employees are entrusted with the health and welfare of some of the most honorable and vulnerable in our nation – our veterans. Patients, doctors, nurses and hospitals rely heavily upon the truth and accuracy of our permanent medical records. The intentional falsification of veterans’ medical records is a serious offense and will not be tolerated.”
    Assistant Inspector General for Investigations Quentin G. Aucoin stated, “The VA Office of Inspector General (OIG) vigorously investigates allegations regarding VA employees who alter medical records with false statements in order to conceal unfulfilled consults for medical procedures. These alleged actions give the appearance that medical care was rendered or, in some cases, the appearance that veterans declined medical care. Alterations of medical records and false statements in these records needlessly expose patients to harm and also undermine the integrity of VA data relied upon by VA decision-makers, who oversee and manage operations.”
    Henderson has been charged with 50 counts of making false statements. If convicted, Henderson faces a maximum sentence of 5 years in prison and a $250,000 fine on each count. An indictment is only an accusation and is not evidence of guilt. The defendant is entitled to a fair trial, during which it will be the Government’s burden to prove guilt beyond a reasonable doubt.
    The case was investigated by Special Agents from the VA-OIG’s Office of Investigations, with assistance from clinical staff in the VA-OIG’s Office of Healthcare Inspections. Assistant United States Attorney Lamont Belk is prosecuting the case on behalf of the United States. Any questions should be directed to First Assistant United States Attorney James D.     (1) Whenever it appears to the department of ecology that a drought condition either exists or is forecast to occur within the state or portions thereof, the department of ecology is authorized to issue orders, pursuant to rules previously adopted, to implement the powers as set forth in RCW 43.83B.410 through 43.83B.420.

    THE DEPARTMENT SHALL, IMMEDIATELY UPON THE ISSUANCE OF AN ORDER UNDER THIS SECTION, CAUSE SAID ORDER TO BE PUBLISHED IN NEWSPAPERS OF GENERAL CIRCULATION IN THE AREAS OF THE STATE TO WHICH THE ORDER RELATES.

    PRIOR TO THE ISSUANCE OF AN ORDER, THE DEPARTMENT SHALL (A) CONSULT WITH AND OBTAIN THE VIEWS OF THE FEDERAL AND STATE GOVERNMENT ENTITIES IDENTIFIED IN THE DROUGHT CONTINGENCY PLAN periodically revised by the department pursuant to RCW 43.83B.410(4), and (b) obtain the written approval of the governor. Orders issued under this section shall be deemed orders for the purposes of chapter 34.05 RCW.

    (2) Any order issued under subsection (1) of this section shall contain a termination date for the order. The termination date shall be not later than one calendar year from the date the order is issued. Although the department may, with the written approval of the governor, change the termination date by amending the order, no such amendment or series of amendments may have the effect of extending its termination to a date which is later than two calendar years after the issuance of the order.

    (3) The provisions of subsection (2) of this section do not preclude the issuance of more than one order under subsection (1) of this section for different areas of the state or sequentially for the same area as the need arises for such an order or orders.

    Upon the issuance of an order under RCW 43.83B.405, THE DEPARTMENT OF ECOLOGY IS EMPOWERED TO:

    (1)(a) Authorize emergency withdrawal of public surface and ground waters, including dead storage within reservoirs, on a temporary basis AND AUTHORIZE ASSOCIATED PHYSICAL WORKS WHICH MAY BE EITHER TEMPORARY OR PERMANENT. The termination date for the authority to make such an emergency withdrawal may not be later than the termination date of the order issued under RCW 43.83B.405 under which the power to authorize the withdrawal is established.

    The department of ECOLOGY may issue such withdrawal authorization when, after investigation and after providing appropriate FEDERAL, STATE, AND LOCAL GOVERNMENTAL BODIES AN OPPORTUNITY TO COMMENT, the following are found:

    (i) The waters proposed for withdrawal are to be used for a beneficial use involving a previously established activity or purpose;

    (ii) The previously established activity or purpose was furnished water through rights applicable to the use of a public body of water that cannot be exercised due to the lack of water arising from natural drought conditions; and

    (iii) THE PROPOSED WITHDRAWAL WILL NOT REDUCE FLOWS OR LEVELS BELOW ESSENTIAL MINIMUMS NECESSARY (A) TO ASSURE THE MAINTENANCE OF FISHERIES REQUIREMENTS, AND (B) TO PROTECT FEDERAL AND STATE INTERESTS INCLUDING, AMONG OTHERS, POWER GENERATION, NAVIGATION, AND EXISTING WATER RIGHTS;

    (b) All withdrawal authorizations issued under this section SHALL CONTAIN PROVISIONS THAT ALLOW FOR TERMINATION OF WITHDRAWALS, IN WHOLE OR IN PART, WHENEVER WITHDRAWALS WILL CONFLICT WITH FLOWS AND LEVELS as provided in (a)(iii) of this subsection. Domestic and irrigation uses of public surface and ground waters shall be given priority in determining “beneficial uses.” As to water withdrawal and associated works authorized under this subsection, the requirements of chapter 43.21C RCW and public bidding requirements as otherwise provided by law are waived and inapplicable. All state and local agencies with authority to issue permits or other authorizations for such works shall, to the extent possible, expedite the processing of the permits or authorizations in keeping with the emergency nature of the requests and shall provide a decision to the applicant within fifteen calendar days of the date of application. All state departments or other agencies having jurisdiction over state or other public lands, if such lands are necessary to effectuate the withdrawal authorizations issued under this subsection, shall provide short-term easements or other appropriate property interest upon the payment of the fair market value. This mandate shall not apply to any lands of the state that are reserved for a special purpose or use that cannot properly be carried out if the property interest were conveyed;

    (2) Approve a temporary change in purpose, place of use, or point of diversion, consistent with existing state policy allowing transfer or lease of waters between willing parties, as provided for in RCW 90.03.380, 90.03.390, and 90.44.100.

    HOWEVER, COMPLIANCE WITH ANY REQUIREMENTS OF (A) NOTICE OF NEWSPAPER PUBLICATION OF THESE SECTIONS OR (B) THE STATE ENVIRONMENTAL POLICY ACT, CHAPTER 43.21C RCW, IS NOT REQUIRED WHEN SUCH CHANGES ARE NECESSARY TO RESPOND TO DROUGHT CONDITIONS AS DETERMINED BY THE DEPARTMENT OF ECOLOGY.

    An approval of a temporary change of a water right as authorized under this subsection is not admissible as evidence in either supporting or contesting the validity of water claims in State of Washington, Department of Ecology v. Acquavella, Yakima county superior court number 77-2-01484-5 or any similar proceeding where the existence of a water right is at issue.

    (3) Employ additional persons for specified terms of time, consistent with the term of a drought condition, as are necessary to ensure the successful performance of the activities associated with implementing the emergency drought program of this chapter.

    (4) Revise the drought contingency plan previously developed by the department; and

    (5) Acquire needed emergency drought-related equipment.

     ALAN REID

    INTRODUCTION

    New Zealand’s natural forests have been the subject of protracted public and political debate regarding the role of Government in forestry and the future use of natural forests during the last three decades. THIS REVIEW COVERS THE EVOLUTION OF THE COUNTRY’S LOGGING BAN SINCE THE EARLY 1970S, when public interest and disquiet over natural forest management became prominent, through late 1999 when the Government decided to phase out the last logging operations on State-owned natural forests in the West Coast region.

    Some events played major roles in the way logging restrictions have been implemented. One was the development of planted forests of introduced species, which eventually became the main source of timber in New Zealand. Another was the reorganization of the Government natural resources administration in the mid-1980s, which resulted in the separation of commercial planted forests and natural forests.

    Prior to these events, large areas of natural forests covering New Zealand’s rugged and erosion-prone terrain were also set aside for water and soil protection. Such reservation became a feature of forest management when the first Government policy on natural forest management and timber sales was formulated.

    The exclusion of timber harvests from other natural forests, as a matter of national policy for conservation reasons, is a relatively recent development in New Zealand. Logging restrictions followed growing public interest in natural forest management in the 1970s, and subsequent political changes affecting forestry administration. The Government reorganized the natural forest administration in 1987. Maturing planted forests provide alternative raw material in many parts of the country, cushioning the effect of these changes in the forest industry.

    After 1987, new policies and legislation focused on private forests. Timber harvests have not been banned in these forests. Commercial timber harvests are, however, restricted by export, sawmilling, and sustainable forest management constraints.

    NATURAL FOREST AREAS AFFECTED BY LOGGING BANS

    Logging restrictions eventually will apply to about 5.1 million ha of New Zealand’s State-owned natural forests. An additional 142 000 ha of State-owned natural forests and about 1.3 million ha of private forests are subject to restrictions that limit commercial timber harvest according to sustainable forest management guidelines. However, much of the natural forests in all ownerships cover steep land and other protection areas. AFTER FORESTS WITHIN CATCHMENT PROTECTION AREAS, NATIONAL PARKS, AND OTHER KEY RESERVE AREAS ARE REMOVED FROM THE AVAILABLE HARVEST AREA, AN ESTIMATED 930 000 HA OF LOGGED AND UNLOGGED FORESTS ON STATE LANDS REMAIN DIRECTLY AFFECTED BY THE LOGGING BAN.     George C. Rains Sr. my Dad, as a private property owner of 3000 acres of timberland in Clallam County WA.  made a trip to New Zealand.  I have his photo album of that New Zealand trip. He took pictures of tree farms. They were beautiful, they looked exactly like a farm, the trees were lined up like corn rows, evenly spaced,  no under growth, and easily identifiable from a distance as a  renewable tree farm.
