    Indeed, Trump Signed an Executive Order to Begin Water Rule Rollback

    In President Trump’s own words, “With today’s executive order I’m directing the EPA to take action paving the way for the elimination of this very destructive and horrible rule,” Trump said.

    “The EPA so-called Waters of the United States rule is one of the worst examples of federal regulation, and it has truly run amok, and is one of the rules most strongly opposed by farmers, ranchers and agricultural workers all across our land,” Trump said. “It’s prohibiting them from being allowed to do what they’re supposed to be doing. It has been a disaster.”

    The rule was signed by President Obama in May of 2015, (the master of several disasters) and went into effect in late August of 2015.

    President Trump’s  Director of Environmental Protection Agency Scott Pruitt was  sworn in on Feb 17, 2017. “They” say….Scott Pruitt is the EPA’s Legal Nemesis

    • CALIFORNIA IS AT CATASTROPHIC RISK FOR DEVASTATING FLOODS.California’s diverse geography contributes to the state’s significant flood risk. In many regions, peak flows — the largest volume of water flowing per second through a water system — occur in a very short time frame, which spells disaster.
    • Flooding is a statewide problem. Every California county has experienced a federally declared flood disaster in the past 20 years. Counties with relatively low risk for a major flood event would be impacted by the results of a catastrophic flood elsewhere in the state, when employment centers, transportation facilities, utilities and the economy are affected.
    • THE IMPACTS OF A MAJOR FLOOD WOULD BE DEVASTATING TO CALIFORNIA AND TO THE NATION.In addition to tragic loss of life, flooding in California can have a serious impact on its economy and environmental resources. A major flood in California, which has one of the world’s largest economies, will have an unprecedented impact on the national economy as well. With many more people and structures per square mile in California’s urban areas, the state would likely see much higher recovery costs from a major flood than the $110 billion that has been spent on recovery from Hurricanes Katrina and Rita or the $60 billion that has been appropriated for recovery from Superstorm Sandy.

    ACROSS THE US AND WORLDWIDE, FLOODING IS THE DEADLIEST AND MOST COSTLY NATURAL DISASTER.  The US National Flood Insurance Program (NFIP) is an imperfect framework for reducing flood losses, but currently the best we’ve got.  NFIP IS SCHEDULED FOR CONGRESSIONAL REAUTHORIZATION IN 2017, and this debate promises to be lively.  The Natural Hazards Research and Mitigation Group at UC Davis has been analyzing NFIP DATABASES, EXAMINING PATTERNS OVER THE HISTORY OF THE PROGRAM AND FOCUSING ON FLOOD LOSSES AND FLOOD INSURANCE, PARTICULARLY IN CALIFORNIA.

    Over the history of NFIP, California is one of a few states that has – through dry years and wet – received only a small fraction of payments from NFIP compared to the premiums it has paid in.  Since 1994, NFIP damage payouts in California have totaled just 14% of premiums collected (compared to 560% for the biggest recipient state, Mississippi).  For California, this imbalance exceeds $3 billion (2015 dollars) over 21 years, funds that could have been invested in risk-reduction, floodplain management, and reduced premiums.

    California has unparalleled expertise and a culture of progressive solutions for managing its flood risk; the state also has unique needs and intense pressures looking forward.  WITH THE US NFIP FACING AN UNCERTAIN FUTURE – >$20 BILLION IN DEBT, AND WITH A CHALLENGING CONGRESSIONAL REAUTHORIZATION DISCUSSION LOOMING IN 2017 – we recommend a careful look at California’s place in the NFIP.  In particular, CALIFORNIA SHOULD NOW EXPLORE A STATE FLOOD INSURANCE PROGRAM, WITH SAVINGS INVESTED IN LONG-TERM RISK REDUCTION.  Properly implemented, a state-based insurance program and proactive flood mitigation strategies could synergistically benefit the environment, agriculture, recreation, and water resources.  THIS APPROACH HAS MAJOR CHALLENGES, WITH IMPLICATIONS BOTH FOR CALIFORNIA AND NATIONWIDE THAT SHOULD BE EXPLORED.

    More than 100,000 Central Valley residents fled towns and farms, bracing for a wall of runoff flowing down from the Sierra. The National Weather Service ranks this as one of the five most disastrous weather events to hit California in the 1900s.

    The flooding’s toll came to eight dead, $1.8 billion in economic losses, 23,000 homes destroyed, and 2,000 businesses damaged or decimated. FORTY-EIGHT COUNTIES WERE DECLARED DISASTER AREAS, INCLUDING ALL 46 IN NORTHERN CALIFORNIA.

    Risk Financing for Flood: Emerging Opportunities

    Flood is the largest contributor to catastrophic loss worldwide. Recent initiatives from Guy Carpenter and Marsh & McLennan Companies, both involving the peril of flood, demonstrate the diversity of approaches that can be brought to bear. In the United Kingdom, we are involved in a project where the insurance industry is working in concert with the government to adjust the industry’s approach to the peril of flood and maintain the private sector’s role as the source of insurance protection without a resultant increase in the public sector’s liability.

    The US residual property insurance market segment is comprised of Fair Access to Insurance Requirements (FAIR) Plans, Beach and Windstorm Plans and two state run insurance companies – Florida Citizens Property Insurance Company (Florida Citizens) and Louisiana Citizens Property Insurance Corporation (Louisiana Citizens). These insurance facilities grew out of the civil strife in the 1960s to ensure continued access to insurance in urban areas. Over time they have evolved and their mandate has grown beyond their urban focus. Today these facilities are significant providers of some of the most wind- and earthquake-exposed property insurance in the country.

Traditional reinsurance remains a core component of most residual market risk financing programs. Typically these risk financing plans will also rely on retained profit, assessments and debt facilities in concert with the various forms of reinsurance to manage their exposures. The utilization of alternative risk financing capital through catastrophe bonds and/or collateralized reinsurance continues to grow with eight of 12 facilities that utilize traditional reinsurance also accessing risk transfer capacity through catastrophe bonds and/or collateralized reinsurance to help manage their loss exposures.     Washington, DC – Today, on World Water Day, Ranking Member of the Energy and Natural Resources Committee U.S. Senator Maria Cantwell (D-Wash.) released a white paper to advance the development of a 21st century national framework for addressing drought and water security in the United States.

    An unprecedented drought last year and 15 years of drought across the American West have demonstrated the need to rethink U.S. water management in the 21st century. Since 1980, droughts have cost the United States more than $200 billion. The drought last year caused widespread and serious impacts for communities, agriculture, industry and the environment. As drought is predicted to continue in the coming years and as communities throughout the United States face significant water-security challenges, it is a crucial time to evaluate and develop new strategies at the national level.  

    Sen. Cantwell’s paper lays out a national framework to address water challenges through the modernization of federal programs to support and finance sustainable, watershed-scale solutions; advance science and technology; and promote partnerships with communities. The purpose of the paper is to foster a public dialogue and to develop a comprehensive policy agenda to address national drought and water security needs, as called for by states, tribes, local governments, utilities, agricultural producers and conservation groups.

    Modernizing federal programs is critical to supporting a more water-secure future,” Sen. Cantwell said. “The Yakima water bill is a national model for watershed management. The federal government has a responsibility to act now to support these efforts.”

    The framework document reflects lessons learned from Washington’s Yakima River Basin, where an extraordinary collaboration has led to a watershed planning effort that has become a national model. Last year, Sen. Cantwell introduced the Yakima Basin bill (S. 1694) to authorize federal participation in this effort, which will help usher in a new era in water management. The bill will help to restore ecosystems and endangered species, conserve water and provide water security for families, fish and farmers for years to come. Last month, Deputy Secretary of the Department of the Interior Michael Connor called the Yakima process a model not only for working through water challenges, but any natural resource management challenge.

    The white paper released today builds on that approach and outlines five policy principles as a national framework for drought and water security:

    1. Supporting collaborative watershed-scale solutions that are locally-driven. Governance solutions should support and incentivize collaborative, locally driven, watershed solutions by modernizing, coordinating, and streamlining federal programs to make them more effective.

    2. Financing solutions through partnerships and streamlined federal funding. Innovative water financing solutions should utilize an integrated watershed funding approach that streamlines federal funding and increases opportunities for public-private partnerships.

    3. Using and advancing the best science, technology and tools. Science and technology solutions should focus on accelerating innovation and the advancement of tipping points in science, technology and tools to transform water management.

    4. Advancing sustainable water supply solutions for people and the environment. Water supply solutions should take an integrated, portfolio approach that balances the needs of both people and the environment, including: (1) increased use of water markets, efficiency, conservation, recycling, reuse and desalination; (2) improvements in existing infrastructure, operations and low-impact infrastructure (such as aquifer storage and recovery); and (3) nature-based solutions and restoration of ecosystems and fisheries.

    5. Partnering with Tribal Nations, Arctic and Island Communities. The federal government should partner with and support Tribal Nations, Arctic and Island communities as they face unique challenges in responding to and addressing long-term water security needs.

    Addressing long-term drought is also a priority for the Obama administration. Ahead of today’s White House Water Summit, the administration released a presidential memorandum to institutionalize the National Drought Resilience Partnership (NDRP), which seeks to reduce the vulnerability of communities to the impacts of drought.

    How does drought response relate to climate preparedness?

    • The President’s Climate Action Plan: In June 2013, President Obama released his Climate Action Plan to cut the carbon pollution that causes climate change and affects public health, including increased risk of drought wildfires.

    THE SUIT IN QUESTION WAS FILED BY 13 STATES (ALASKA, ARIZONA, ARKANSAS, COLORADO, IDAHO, MISSOURI, MONTANA, NEBRASKA, NEVADA, NEW MEXICO, NORTH DAKOTA, SOUTH DAKOTA AND WYOMING),
    which claimed, among other things, that the WOTUS rule is a threat to state sovereignty because it asserts federal jurisdiction over WETLANDS AND WATERS (AND EVEN SOME RELATIVELY DRY LAND)that should be subject to state government control. As a general matter (and as the Supreme Court has recognized) land-use control is generally beyond the scope of federal power. In this case, the district court concluded that the states were likely to succeed on the merits as the EPA had adopted an “exceptionally expansive” view of its own jurisdiction under the CWA. According to the court, the WOTUS rule “allows EPA regulation of waters that do not bear any effect on the ‘chemical physical, and biological integrity’ of any navigable-in-fact water,” and therefore exceeds the limits on federal regulatory authority identified by the Supreme Court in Rapanos.
    The EPA, said it will only honor the injunction in the 13 states that had sued, and will move forward with the rules in the rest of the country.

    What’s Up With WOTUS?

    Implementation of the Clean Water Rule: Definition of “Waters of the United States” (usually referred to as the WOTUS rule) was set to become effective on August 28, 2015. Several lawsuits were filed by agricultural groups, among others, requesting a preliminary injunction, or order, to halt the rule’s implementation until lawsuits could be settled. Late in the afternoon on August 27, a District Court judge in North Dakota issued a preliminary injunction stopping the WOTUS rule from going into effect for thirteen states, including Nebraska.
    FOR ALL OTHER STATES WHO DIDN’T HAVE PRELIMINARY INJUNCTIONS ISSUED, THE RULE TOOK EFFECT AS PLANNED ON AUGUST 28, 2015.

    Why were lawsuits filed against the EPA and Army Corp of Engineers (CORP) following release of the final WOTUS rule? Several lawsuits were filed following publication of the final WOTUS rule in the Federal Register.

    Twenty-seven states, along with industries from petroleum to construction, and agricultural groups such as the American Farm Bureau Federation, National Cattlemen’s Beef Association, National Corn Growers Association, and National Pork Producers Council all filed separate lawsuits. These numerous lawsuits have since been consolidated into a single lawsuit that identifies three arguments for vacating the rule.

    The first argument is that the finalized WOTUS rule exceeds the intended purposes of the Clean Water Act and represents an unconstitutional overreach by the federal government on land. Second, the rule-making process is designed to give the public an opportunity to comment on all aspects of a rule. In this case, EPA added items to the final rule that were not in the proposed rule.

    The third, and perhaps most concerning argument, is that the EPA may have inappropriately worked with environmental activists to lobby for the rule and support the agency’s agenda. If true, this represents an abuse of the federal rulemaking process by the EPA.

    What does the temporary injunction mean for Nebraska farmers? It means that, for now, the status quo will be maintained. So current guidance documents and existing regulations for making “jurisdictional determination” will continue to be used by the Corp. New definitions and parameters outlined in the WOTUS rule will not be part of the Corp’s checklist when making these determinations in Nebraska. Jurisdictional determination simply means that the Corp reviews the necessary checklist regarding features of a water body, and possibly conducts an on-site inspection, to make a decision about whether the water body should be under their jurisdiction as “waters of the U.S.”

    The temporary injunction does not halt the rule entirely; it simply postpones implementation of the rule until legal proceedings are completed (which could take months or even years as we saw with the new AFO/CAFO regulations a few years back).

    If the pending lawsuits are not successful, and the WOTUS rule is eventually implemented in Nebraska, it remains to be seen what parts of the rule will remain and which will not. In Nebraska, we’ll cross that bridge when we get there.

    UPDATE: On Friday, the plaintiff states informed the court that the U.S. EPA had announced it would continue to apply the WOTUS rule in states that did not challenge the injunction.

    Late Friday, the district court responded with an order for supplemental briefing on whether the injunction “applies nationally or in a limited geographic area.” Briefs are due on Tuesday, September 1.

    California Farmers Claim EPA Water Rules Extend To Dirt Fields

    SAN JOAQUIN COUNTY (CBS13) — Farmers say federal regulators are going too far and are taking away their water and chipping away at their property rights under a new rule.
    The Environmental Protection Agency says any bodies of water near a river, or standing water that can affect waterways will fall under federal regulation.
    Since the 1980s, the EPA has regulated any water you can navigate through, including rivers and large lakes. But the new Clean Water Act Rule will add smaller bodies of water to the government’s oversight.
    Bruce Blodgett with the San Joaquin Farm Bureau says the new rule would include any standing body of water, and dry land that can potentially hold water.
    “This field is a great example,” he said. “This dirt field would now be ‘waters of the U.S.’ under this proposed rule.”
    The bureau says the new rule allows the government to require farmers to get permits to farm from the U.S. Army Corps of Engineers.
    “We have a lot of fields that are fallow, sitting idle this year, because of the drought,” he said. “That will enable the Corps to come after those lands when they try to bring them back into production next year saying, ‘No, those are now waters of the U.S.’”
    Under the new Clean Water Act rule, the bureau claims any private property with a pond and any farm with an irrigation district is now under federal regulation.
    But the EPA says, that’s not true. It says the new rule applies to tributaries and water near rivers that could seep into waterways and affect the environment . The agency says it’s not going after ponds and won’t interfere with farm irrigation. It says ditches that are not constructed in streams and that flow only when it rains are not covered.
    A federal court has granted 13 states a stay on the orders while it examines a lawsuit. California is not part of the lawsuits, but farmers are watching.

    Ecclesiastes 1:6-7, “The wind blows to the south and turns to the north; round and round it goes, ever returning on its course. All streams flow into the sea, yet the sea is never full. To the place the streams come from, there they return again.

    Here King Solomon, writing 3,000 years ago explains how the oceans are the origin of rain. tells us the wind has currents. This was unknown to  man,

    TODAY SCIENCE HAS DOCUMENTED THE DIRECTION OF WIND CURRENTS AND WIND PATHS. 

     METEOROLOGY OR THE CIRCULATION OF WINDS MOVE BY FIXED LAWS,

    speaks of global wind currents and the earth’s water cycle. “The phrase, ‘the wind blows to the south and turns to the north; round and round it goes, ever returning on its course’ is an accurate and astonishing description of

    the circular flow of air around the earth, called the ‘JET STREAM,’ well known to anyone who watches the evening news weather reports”( also in Isaiah 40:12.)

     THIS IS ONLY A RECENT UNDERSTANDING OF SCIENTISTS.

    As part of the cycle, an electrical field generates within a cloud and acts as a kind of magnetic glue that causes the water particles to adhere to one another. The same field also produces lightning. “He makes clouds rise from the ends of the earth,” writes the psalmist, “he sends lightning with the rain and brings out the wind from his storehouses” (Psalms 135:7). This one verse clearly outlines four aspects of the hydrologic cycle: evaporation, wind, electricity, and rain.

    God “sends lightning with the rain,” Jeremiah says on two separate occasions (Jeremiah 10:13; 51:16). The important emphasis in each case is that rain and electricity are linked.

    A U.S. STUDY is under way to evaluate several possible ways TO LIMIT CLIMATE CHANGE including solar radiation management and carbon dioxide removal.

    The study will primarily be an analysis of peer-reviewed literature, and will not involve any substantial new research, experimentation, or development of new geoengineering technology, spokeswoman Lauren Rugani of the National Academy of Sciences said.

    “The project’s main goal is to provide a technical evaluation of proposed geoengineering techniques such as carbon dioxide removal and solar radiation management,

    TO DETERMINE WHAT WE KNOW AND DON’T KNOW ABOUT THEIR PHYSICAL CAPABILITIES, TECHNICAL FEASIBILITIES, KNOWN RISKS, AND INTENDED OR UNINTENDED CONSEQUENCES,” Rugani said.

    The evaluation would include general comments on how using such technology may impact the environment, economy and national security. THE STUDY COMMITTEE INCLUDES EXPERTS in oceanography, earth sciences, environmental sciences, remote sensing, global ecology, marine chemistry and geochemistry, public policy, history of science, atmospheric and climate science and national security, Rugani said.

    Most of the proposed geoengineering techniques for solar radiation management and carbon dioxide removal being discussed have GLOBAL IMPLICATIONS and are generally discussed in a GLOBAL CONTEXT, Rugani said.

    “The study may discuss what is known about regional effects from various proposed techniques, but that will depend what peer-reviewed literature is available on those effects,” she said.

    The project is supported by the Academy, the U.S. intelligence community, the National Oceanic and Atmospheric Administration and NASA.

    Changing the Weather

    Attempts to change the weather have taken on various forms for about 70 years.

    Agencies have used cloud seeding to bring rain and snow to parched areas of the western United States. The U.S. government tried to research and modify hurricanes from the early 1960s to the mid-80s, an effort that was unsuccessful.

    Indonesia used cloud seeding in June to help douse forest fires. The Chinese government used its weather modification branch to work on a rain-free Beijing Olympics in 2008.

    So what’s next for weather modification?

    “In its report, the committee may briefly discuss weather modification as a historical example and draw on ‘lessons learned,'” Rugani said.

    Weather modification is the process of modifying the weather to enhance rainfall and/or suppress hail with the use of glaciogenic (silver iodide) and/or hygroscopic (calcium chloride) material, Project Meteorologist Jonathan Jennings of the West Texas Weather Modification Association said.

    Aircraft or ground base generators are used to deliver the materials into the clouds, he said.

    “In Texas, our operations are conducted by seeding at the base of a convective thunderstorm with an aircraft. Our pilots and meteorologists (on the ground) work together via radio contact to identify target clouds and areas of inflow,” Jennings said.

    “We rely on the inflow to transport our material into the areas of the cloud that the material is expected to impact. The meteorologists are licensed by the state of Texas to perform these operations. The main tools used are satellite imagery and radar via a program called TITAN (Thunderstorm Identification, Tracking, Analysis and Nowcasting) supported by the National Center for Atmospheric Research.”

    Safeguards are in place to curtail or stop cloud-seeding programs on predetermined criteria.

    “For example, on our program in North Dakota we do not seed storms that are producing a funnel cloud or tornado, and we also suspend operations during flash flooding situations. Winter programs generally have snowpack criteria by which seeding may be suspended, based on the percentage of normal precipitation and how far along they are in the snow season,” said Darin Langerud, director of the North Dakota Atmospheric Resource Board, who is part of the North American Weather Modification Council.

    Cloud seeding produces no significant environmental effacers but does enhance precipitation by 5 to 15 percent and can reduce crop-hail damage by 40 to 45 percent, Langerud said.

    “The economic benefits of increasing precipitation and reducing hail damage are too numerous to list, but in general, the benefits of extra water in the form of rain and snow and reduced crop-hail damage produced from cloud seeding far outweigh the costs,” he said. “Water produced from cloud seeding can cost as little as a few dollars per acre-foot. Desalination, for example, produces an acre-foot of water for roughly between $500 to $2,000 per acre-foot.”

    WEATHER WARFARE IS BANNED UNDER A 1980 TREATY TO WHICH THE U.S. IS A SIGNATORY, “BUT” the U.S. intelligence community definitely has an interest in such technologies, said John E. Pike, director of GlobalSecurity.org, a security think tank in Alexandria, Va.

    “Because global warming may impact the security of other countries and CREATE PROBLEMS FOR THE U.S. GOVERNMENT,” Pike said. One national security benefit would be to prevent state failure in Africa, particularly in a nation such as Somalia, which has suffered through famine and a long-term civil war.

    It also would be perfectly ethical for the U.S. government to use weather modification to save lives and money, Pile said.

    Once upon a time, God was missing for six days.

    Eventually, Michael, the Archangel, found him, resting on the seventh day. He
    inquired of God. “Where have you been?”

    God sighed a deep sigh of satisfaction, and proudly pointed downwards
    through the clouds, “Look, Michael. Look what I’ve made.”

    Archangel Michael looked puzzled, and said, “What is it?”

    “It’s a planet,” replied God, “and I’ve put Life on it. I’m going to call it
    Earth and it’s going to be a great place of balance.”

    “Balance?” inquired Michael, still confused. God explained, pointing to
    different parts of earth. “For example, northern Europe will be a place of great
    opportunity and wealth, while southern Europe is going to be poor. Over there
    I’ve placed a continent of white people, and over there is a continent of black
    people.” “Balance in all things,” God continued pointing to different countries.

    The Archangel, impressed by God’s work, then pointed to a land mass and

    Ah,” said God “That’s Washington State, the most glorious place on earth.
    There are beautiful streams, hills, and forests. The people from Washington
    State are going to be handsome, modest, intelligent and humorous, and they are
    going to be found traveling the world. They will be extremely sociable,
    hardworking, high achieving, and they will be known throughout the
    world as diplomats, and carriers of peace.”
