    Dallas police shooting: Live updates as five officers killed during Black Lives Matter protest

     

    An ex army veteran used his military training to carry out a coordinated ambush which left five police officers dead.

    Former corporal Micah Xavier Johnson used an AR-15 style rifle to target white officers at a Black Lives Matter protest in Dallas, Texas on Thursday night.

    Horrifying footage emerged showing a police officer being executed at point blank range and another from a man who live streamed the shocking scenes.

    25-year-old Johnson’s massacre ended after an intense firefight with police when he was blown up by a robot sent in carrying a bomb.

    Three other people, two men and a woman, were arrested but officials have said Johnson was a lone gunman.

    The victims have been named as Senior Cpl. Lorne Ahrens, 48, Officer Michael Krol, 40, Sgt. Michael J. Smith, 55, Officer Patrick Zamarripa and Dallas Area Rapid Transit (DART) police officer Brent Thompson, 43.

    Racial tensions have been rising across the country after the shooting dead of several unarmed black men – the full background on that here.

    According to the news story from Portland Oregon: “Officials investigating the death of Robert [LaVoy] Finicum are ready to release results” of the fatal shooting “during a Jan. 26 traffic stop while trying to arrest the rancher and others involved in the takeover of an Oregon wildlife refuge.”

    — LaVoy Finicum’s wife Jeanette Finicum released this statement at a news conference in St. George, Utah:
    The news conference held earlier today in Bend, Oregon to release the report of the investigation regarding my husband’s death was to be expected. No surprises. The purpose of that announcement was for state and federal agencies to continue to lay the foundation of their legal case.
    However, they also continue to bring forward selective evidence. As in all such situations there is another side to this story. We will provide a more thorough analysis at a follow up news conference tomorrow and will be taking questions at that time. Meanwhile, we continue to maintain my husband’s innocence.
    According to the news story from Portland Oregon: “Officials investigating the death of Robert [LaVoy] Finicum are ready to release results” of the fatal shooting “during a Jan. 26 traffic stop while trying to arrest the rancher and others involved in the takeover of an Oregon wildlife refuge.”
    As a family, along with our lawyers, we deny this statement. This was not a traffic stop. It was an ambush with a roadblock placed on a blind curve along a lonely stretch of highway. I am told that in law enforcement and prosecuting circles this is called a “Deadman’s blockade,” and is designed to allow a “kill stop” which is illegal.
    The news story continues: “The FBI said Finicum was shot after reaching for a gun…”. We reject that statement. The FBI’s aerial video was of poor quality, edited and provided no audio. Our family asserts that he was shot with both hands up, he was not reaching for anything at the time of the first shot. He was walking with his hands in the air, a symbol of surrender. When he reached down to his left hip he was reacting to the pain of having been shot.
    I can hardly believe that a team of qualified law officers could look at the facts in this case and say that no criminal laws were violated.
    How could they have reached this decision in the face of evidence that clearly shows intent to kill my husband?
    We have talked with an independent investigator who has stated that the “video proves a set up assassination.”
    Many people, including my lawyers, have tried to prepare me for this—-“be strong”, “accept this with peace” —–but I don’t think anything could prepare me to accept what is so clearly a finding that challenges the Constitution that my husband died defending.
    I know that under the Constitution the men who shot my husband to death, while he was surrendering, are entitled to due process of law—-but they are not entitled to walk free and not have to face the same legal process that is a barrier to you or to me.
    They shot my husband, they left him lying in the snowbank—no medical assistance, no charges, no arraignment, no preliminary hearing, no indictment, and no trial by a jury, — and should they just walk free? It just is not right.
    The consolation I have is that hundreds of thousands of Americans have seen and know the truth and believe as I do that my husband was murdered “intentionally, deliberately and with malice.”
    My lawyer has assured me that we will seek justice in a different court, under different circumstances—and I look forward to the day when these men do face a jury that is unbiased enough to return a fair verdict.
    After the Finicum funeral, rallies spontaneously began to organize in many states. The organizers counted, possibly as many as 300 rallies took place throughout the country, in every state but Rhode Island.
    It has been asked how this movement got such momentum so quickly. When Americans heard the details of this story and how these American patriots who have no criminal record and who have stood on the same interpretation of the US Constitution as Justice Scalia have been treated, the actions of law enforcement and the FBI have “shock [ed] the conscience.” Our Supreme Court has set as the standard guideline for practices of law enforcement that are unacceptable to our society, as those that “shock the conscience”.
    A Deadman’s blockade with the intent to kill “shocks the conscience.” Shooting to kill with both hand up “shocks the conscience.”
    Violating the 8th Amendment – cruel and unusual punishment – by placing Americans with no criminal records, who are apparently guilty of defending the US Constitution and the overreach of federal authorities, into solitary confinement and then removing their constitutional right to bear arms are two examples of how elected and appointed officials in the court system, legislative bodies and in law enforcement are violating the Constitution they swear to uphold.
    The Supreme Court has referred to solitary confinement as being “violently insane.” The court has recognized that solitary confinement tortures our human brain and diminishes our God given strength to overcome obstacles.
    Solitary confinement is a form of torture that often drives prisoners mad.
    Last year a Supreme Court Justice wrote a concurring opinion that described the history of solitary confinement and said the practice bears a “peculiar mark of infamy” in its ability to shatter the minds and spirits of prisoners.
    Who are we? We are outraged that men and women who have no criminal records and who posed no threat during the protest in Oregon are being treated as mere animals.
    The American people are outraged at this inhumanity, this brutality and barbarism by the courts and law enforcement. It has created a new American awakening from both the Left and the Right. It “shocks our conscience.” And that is why around 300 rallies spontaneously organized in support of my husband’s assassination and these patriots who are being held as political prisoners.
    Again, my lawyer has assured me that we will seek justice in a different court, under different circumstances—
    We will be commenting on the FBI’s and Deschutes County press release tomorrow after we review their findings fully.

    Since the shooting, which was captured on video from the FBI’s birdseye view, there have been many theories surrounding the death of Finicum.

    According to the official story, Lavoy Finicum was killed by officers because they had no other choice as he was reaching for a gun in his left pocket. Officials claim they later found a loaded 9 mm semi-automatic handgun in that pocket.2

    It is evident from the video that Finicum never presented the handgun. However, we can clearly see him reaching for his left side.

    The newly released video shows that officers and agents opened fire on the vehicle prior to Finicum exiting it.

    The people in the SUV were pinned down and being painted by laser sights, so they couldn’t leave the vehicle — yet the agents kept pumping tear gas rounds into it.

    Did they want to flush them out, and gun them down? Would anything else make sense?

    The dramatic scene unfolded as Finicum exited the truck and repeatedly told officers to “shoot me.” At approximately 5:36 in the video, it appears that Finicum could have been shot.

    Seemingly, Finicum’s intentions were to draw fire away from the truck — and that is exactly what he did. This cost him his life.

    The last scene in the video shows a terrified little girl, Victoria Sharp, the 18-year-old gospel singer emerging from the SUV, her hands upraised, and her body painted by laser sights.

    One targeted her head, the other the center of her chest.

    On Tuesday, the state troopers involved in the killing of Lavoy Finicum were found justified in their actions.

    “All six shots fired by the Oregon State Police, the three into the truck and the three that struck Mr. Finicum, are justified,” said Malheur County District Attorney Dan Norris in a prepared statement. He said the shots were “in fact, necessary.”

    “Mr. Finicum repeatedly and knowingly made choices that put him in this situation,” Harney County District Attorney Tim Colahan said in a prepared statement. “It was not the outcome that any of us wanted but one he, alone, is responsible for.”

    Although Norris announced that the shots were justified, a shroud of conspiracy and misconduct remains. After announcing that the state troopers committed no wrongdoing, it was announced that multiple FBI agents are under investigation who were on the scene that day.

    Authorities revealed that at least one FBI agent is suspected of lying about firing twice at Robert “LaVoy” Finicium, and may have gotten help from four other FBI agents in covering it up afterward.

    Immediately after admitting that the agents were under investigation, officials quickly noted that none of the shots fired by the unnamed agent, who is part of an elite national strike unit, hit Finicum. Inspector General Michael Horowitz is now in charge of that separate investigation.+

    ST. GEORGE, Utah (ABC4 Utah) The shooting death of the Arizona rancher killed during the Oregon occupation of a wildlife refuge was justified, according to the Malheur County District Attorney. Yet, Robert “LaVoy” Finicum’s widow insists it was a set-up assassination Tuesday. “My husband was murdered intentionally, deliberately and with malice,” Jeanette Finicum said. On the steps of the Washington County building, surrounded by Finicum’s mother, brother and daughter, his wife explained what she thinks happened on January 26. She says it was not a typical traffic stop. “It was an ambush involving a road block on a blind curve along a lonely stretch of highway, a dead-man’s blockade, a kill stop which is illegal,” Jeanette said. In aerial video released by the FBI, Finicum is shownpulled over in his truck before taking off and plowing into a snow bank. He gets out with his hands up at first, then appears to reach toward his jacket pocket at least twice. The FBI says he was reaching for a loaded handgun.     Robert “LaVoy” Finicum, 54, was killed Jan. 26 as law enforcement officers tried to arrest him along with other key figures in the takeover of the Malheur National Wildlife Refuge.

    The investigation found that the shots fired by Oregon State Police were justified and necessary. Eight shots were fired, six by the Oregon State Police. Two shots were fired be an FBI agent.

    Shooting death of LaVoy Finicum justified, necessary, prosecutor says

    The investigation into the death of LaVoy Finicum, killed during the occupation of Malheur National Wildlife Refuge in January, shows that the three fatal shots fired by Oregon State Police were justified “and, in fact, necessary,” Malheur County District Attorney Dan Norris said Tuesday. In total, eight shots were fired, though flash-bang grenades and gas projectiles were also deployed to ensure three remaining occupants in Finicum’s truck surrendered peacefully, the investigation showed. Authorities dismissed accounts that law officers fired more than 100 rounds of bullets, suggesting that the flash-bang grenades and projectiles may have been mistaken for gunfire. The police provided reporters with video of Finicum’s truck barreling at an estimated 70 mph toward a roadblock of two trucks forming a V in the middle of the road. A third vehicle was parked behind those trucks. The video reveals a fast exchange of words between Finicum behind the wheel and a female passenger inside the truck. “Hang on!” Finicum tells the occupants inside the truck as a shot is fired, apparently by authorities. He is driving the truck. “OK, they’re shooting,” the woman says. Finicum was driving one of two vehicles authorities tracked leaving the Malheur refuge January 26. One ­ carrying Ammon Bundy, the protest leader whose father, Cliven, was at the center of a similar armed standoff in 2014 ­ pulled over to a stop, and the people inside came out peacefully. The officers believed Finicum “planned to crash through or otherwise evade the roadblock” and could injure or kill law enforcement officers at the scene, Norris said. They fired at the truck three times but hit no one inside the truck. Just before Finicum arrived at the roadblock, he veered left into a snowbank at an estimated 50 mph, narrowly missing a federal agent who was trying to get out of the way, the video showed. As Finicum exited his vehicle with a loaded Ruger 9 mm handgun in the left-hand interior pocket of his jacket, he was instructed to get on the ground three times, Deschutes County Sheriff L. Shane Nelson said. The video also shows Finicum exiting the truck. “Stay down,” the woman tells the two other people inside the truck. Then gunfire is heard. “Are they shooting him?” the woman asks. A transcript provided Tuesday shows the exchange between Finicum and officers after he exits his truck. “Go ahead and shoot me,” Finicum tells the officers on at least four occasions. “Get on the ground,” officers tell Finicum on at least two occasions, according to the transcript. “You’re gonna have to shoot me,” Finicum tells the officers at least twice. Despite Finicum defying those orders and reaching toward the pocket containing the gun, two nearby state police officers did not immediately open fire, and a third officer attempted to move in with a Taser, Nelson said. Finicum was out of range of the Taser, he said.     Chaffetz wants to take guns away from BLM, Forest Service agents
    Law enforcement agents with the Bureau of Land Management and the U.S. Forest Service are too “Rambo” to Rep. Jason Chaffetz’s liking, so he wants to take away their guns and authority. Chafftez, R-Utah, said he plans to introduce a bill next week to strip those two agencies of their law enforcement authority and instead set up a system of block grants to states with a lot of federal lands within their borders to augment local law enforcement response.

    “Let’s not kid ourselves. The blood pressure is running high, especially in southern Utah, and I don’t want anyone to get killed,”

    Chaffetz said, adding his bill has the endorsement of his Utah colleagues in the House. Chaffetz said he also wants to issue subpoenas to the “out of control” federal agencies to learn why they want to purchase submachine guns. He said he has had repeated meetings and sent letters to the BLM’s national director, Neil Kornze, with no satisfactory response to his questions. “I want to know what kind of arsenal they have. I’m met with blank stares,” he said. “They’re wholly unresponsive. They don’t feel compelled to answer our letters.” Chaffetz said it makes more sense to have elected county sheriffs with public accountability in charge of law enforcement functions in their own geographic areas. “If it is really serious, you’re going to call the FBI anyway.” The increasing militarization of certain federal agencies has caused political angst and rural pushback in Utah and other parts of the West, especially as public lands issues have become more heated. In 2014, Rep. Chris Stewart, R-Utah, announced efforts to defund law enforcement functions of agencies that include the U.S. Environmental Protection Agency and the U.S. Department of Education.
